commenced in the Superior Court
of Carteret County, in vwhich the
678.21 with interest from the 15th
plaintiff claims the sum of $3,
day of September, 1948, on account
of a breach of contract on the part
of said defendants; that plaintiff
and defendants entered into a con
tract whereby plaintiff was "to
spend all. of his time and effort
solely for Beaufort Cannery as
field supervisor and farmer coiftact
man for all our farms under Con
tract and also manage our rent
ed farm in a competent and effi
cient manner, and cooperate fully
on all question relating to Beaufort
Cannery"; that under said written
contract and a subsequent oral con
tract, plaintiff was to receive cer
tain commissions and percentages
of profit on produce and canned
goods, as set forth more fully in
complaint filed herein, but that
defendants refused and still refuse
to pay plaintiff his said commis
sions and percentages of profit,
thcrby breaching their contracts.
Said defendants will also take
notice that they arc renuired to
appear at the oiiicc oi tne under
signed Clerk of the Superior Court
of Carteret County on the 11th day
of March, 1949, and answer or de
mur to the complaint, or plaintiff
will apply to the Court for the re
lief therein demanded.
Said defendants will further take
notice that in said action a war
rant of attachment against the
property of said defendants has
been irued and the fololwing prop
erty attached: Lots 30, 35, 4u
and 45 of Hednck Town, sec map
recorded in Book MM, page 511,
with machinery, articles of per
sonal property and improvements:
and two 1948 Ford Trucks, Stake
Body; and that said warrant of at
tachments together with the sher
iff's returns was delivered to the
clerk of the Superior Court of
Carteret County on the 23rd day
of December, 1948.

cal Government Commission as
provided in Para. 6 hereof, that an
election shall be held under oen
oral Statutes of North Carolina,
Chapter 160, Section .387, and re
lated acts, submitting the question
of said bond issue to the voters of
the Town; and this ordinance shall
not take effect until the assent of
the voters is had at said election.
The foregoing ordinance was
passed unanimously on the 1st day
of Feb., 1919, and was first pu-
lished and posted the 4th day of
February, 1949.
Any action or proceeding ques
tioning the validity of said ordi
nance must be commenced within
30 days after its first publication.

BE IT ORDAINED BY THE
BOARD OF COMMISSIONERS
OF THE TOWN OF NEWPORT:
1. That the Town issue its bonds
under the conditions herein set out
for the purpose of installing a wa
ter system for the Town, as fol
lows: the installation of the 50,000
gallon wood water tank, pipes and
incidents thereto now owned by
the town and having been purchas
ed from the United States Govern
ment, including a well and pump
and incidents thereto; that the
period of usefulness of said water
system is determined to be 40
years.
2. That IUp bonds necessary to
accomplish the aforesaid purpose
shall be issued only as necessary
and not in excess of $50,000.00;
nor shall any bond be issued for
a longer period than 40 years.
3. That there shall be levied
and collected annually a tax on the
assessed property of the town suf
ficient to pay the principal and in
terest on said bonds, having regard
for available funds for that pur
pose. 4. That the following is a state
ment of the debt of the Town as
filed with the Town Clerk, same
to be open to inspection at all
times:
1. That Ihc gross debt of the town
is: None.
2. That the oustanding debt not
evidenced by bonds is: None.
3. Bonded debt to be incurred
under ordinance introduced: Aft
amount necessary and not exceed
ing $50,000.00.
4. Amount of unissued bonds;
None.
5. Amount of sinking funds for
payments of gross debt; None.
6. Amount of uncollected special
assessments theretofore levied on
account of local improvements:
None.
7. Amount of special assessment
to be levied on account of local
improvements for which gross debt
was or is to oc incurred: ionc;
except, regular tax rate to retire
bonds.
8. Amount of bonded debt in
cluded in gross debt incurred or
to be incurred for water: Not in
excess of $50,000.00.
9. Amount of existing bonded
debt included in gross deht incur
red or to be incurred for sewage;
None.
10. Amount municipality will re
ccivc from railroad for eliminating
grade crossings: None.
11. Indebtedness for school pur
poses: None.

5. That this ordinance shall not
take effect until Section 32, Chap
ter 225, Private Laws of North Ca
rolina, 1927, is repealed; said sec
tion being the provision in the
Town Charter setting out the
Saint Bernard dogs are named
for a mountain in Switzerland near
which the breed was developed
and where the dos were used to
help rescue travelers lost in the
snow.
