Highway Commission Says
Right-of-Ways Must be Free
Raleigh ? The State Highway
Commission recently served notice
on sign potters, and all other per
sons who own, put up or control
roadside advertising signs on the
highway right of way. In a reso
lution adopted at the Jan. 28 meet
ing of the commission, any adja
cent land-owner who allows or per
mits an advertising sign to be
erected on the highway right-of
way is now just as responsible as
the firm or person who erects the
sign.
The commission stressed its plans
to chase all signs, buildings, and
other unauthorized intruders off its
right of way. Under the new ruling
the owner of a roadside business
can be prosecuted when an adver
tising sign is placed outside his
place on highway property, even
though he may claim he doesn't
own the sign.
Formerly, only the advertising
firm or the sign board company
which owned and erected the sign
was guilty. The commission already
has laws- under which owners of
offending signs, gas pumps and the
like can be prosecuted for tres
passing on its highway right of
way.
Penalties May Go Up
Before the recent ruling making
the land owner jointly responsible
was made, the penalty was limited
to $10 Now, that may run as
high as the judge thinks wise. Sep
arate penalties may be imposed for
each day the sign is allowed to
stand after it is ordered removed..
Also, the Commission said many
a Tar Heel has found himself in
a hopeless situation because he
neglected to buy or build on the
kind of road he wants.
Many people have bought low
cost h6mcs in poorly engineered
housing developments. They are
told that arrangements have been
made for keeping up the streets.
Only later, do the new home-own
ers learn that the streets are no
body's responsibility. When they
come to the nearest highway of
fice with requests that their streets
or roads be added to the highway
system, all too often their requests
have to be denied.
Why? Usually, bccause the
streets are not built to State High
way Commission standards or be
cause at least 60 feet has not been
set aside for street right of way.
Often the commission can't take
over the streets, even if they wish
ed to, because the right of way may
be half the width the commission
requires.
Items Listed
Lest other Tar Heels stumble in
to a similar predicament, the com
mission urged prospective home
owners to remember:
1. Don't buy a lot or house off
a paved city street or off a paved
state road unless you know for
sure that the road you get will be
all you want.
2. Don't buy or build in a sub
division until you know for a fact
that definite arrangements have
been made for maintaining the
roads and streets.
3. Don't assume when you build
that the Highway Commission will
take over the upkeep of the road
past your new property. The com
mission has so many such requests
that many must be declined or at
least delayed.
4. If you locate on a dirt road
maintained by the state, don't as
sume the Highway Commission will
pave it Try to locate on a road
that already is paved.
5. If you do locate in a subde

Education Board
To Set Formula
For Allocation
Four members of the State Board
of Education have been given the
tasjc of developing a formula., (or
the distribution of $25,000,000 of
the 50 million dollars provided
from a bond issue authorized by
the General Assembly of 1953 for
the construction and improvement
of school plant facilities.
The bond issue was voted favor
ably by the people of the state in
an election Oct. 3, 1953.
Under the law $100,000 of the 50
million dollars voted shall be al
located to each of the 100 counties
of the state ? a total of 10 million
dollars; and 15 million dollars shall
be allocated on the basis of aver
age daily membership for the
school year 1951-52 when a valid
need for such funds is shown.
The balance, or 25 million dol
lars shall be distributed to the units
on the basis of standards deter
mined by the State Board of Educa
tion and approved by the Governor.
At the December meeting of the
Board, Lt. Governor Hodges,
chairman of the board, appointed
members J. A. Pritchett, Santford
Martin. A. S. Brower, and Superin
tendent Chas. F. Carroll as a for
mula committee to direct a study
and develop a formula to be used
in allocating this second half of the
50 million dollar fund.
