Adams, Jr. as Trustee, dated August 1, 1941 and duly registered in the office of Register of Deeds for Yfthcey County, North Carolina, August 9, 1941 in Book' of Mortgage Deeds No. 27, at page 541, de fault having been made in the payment of the matured indebt edness and interest secured by said Deed of Trust and such de fault having continued for a per iod of thirty days, and the owner and holder of the note secured by said Deed of Trust having de clared the whole of the said in debtedness represented by said note and secured by, said Deed of Trust due and payable and has requested the undersigned Trustee to exercise the power of sale contained in said Deed of Trust, the said undersigned Trustee will, at the County Court House door in the Town of Burnsville, North Carolina, at 12:00 o’clock Noon on Friday, the 16th day of Oct ober, 1942, sell, at public auction to the highest bidder, for cash, all the following described prop erty, rights and privileges. (a) That certain lease, and the. leasehold estate thereby created, and the entire interest of said Mas-Celo Mines, Inc. in the min ing property in Yancey County, North Carolina, held under and by virtue of said lease which was executed by Yancey Cyan-.te Com pany to Joseph T. Tower, dated July 17, 1930 and registered in the office of Register of Deeds for Yancey County, North Caro lina, in book 71, at page 420, to gether with all rights and privi leges incident to or granted by any and all amendments to said le ase; but only upon condition and to the ex'tent that the said Mas-Celo Mines, Inc\ hdcT the right and power to assign said lease and said leasehold estate pursuant to the terms of said lease without in any way invalidating , said lease or violating any term, cov enant or condition 1 thereof. (b) All the right, title, interest and estate of the said Mas-Celo Mines, Inc. in and to the buildings, improvements, facilities, plant, machinery, equipment, tools, ap pliances and supplies, whether lo cated on the land described in the above mentioned lease or else where, now owned, or in the pos session of said Mas-Celo Mines, Inc. and now or heretofore used or employed in connection with, or in relation to, the mining op eration conducted on said land by Mas-Celo Mines, Inc. (c) Those certain Letters I at— ent and patent-rights owned by the Mas-Celo Mines, Inc. covered by Letters Patent of the United States of America No. 2,091,691, issued in the first instance to S. R. Scholes and thereafter assign ed by him to Celo Mines, Inc., • subject, however, to a certain irrevocable non-exclusive license under said - patent granted to Corning Glass Works, a New York Corporation, to practise the inventions thereof for the full life of said patent and any reissues ‘hereof. (d) All personal property of ev ery kind and character owned by said Mas-Celo Mines, Inc. and used or employed, or intended to l,e used and employed in con nection with, or jn relation to, the aforesaid mining operations. (e) The property described in subdivisions (b) and (d) above shall not be deemed to include dislodged or processed ore or sup plies customarily consumed or in tended for sale or use in con nection with the aforesaid mining operations. Together with all appurtenan ces, rights and franchises there unto belohging or appertaining, all as fully described in, and con veyed by, the aforesaid Deed of Trust. - As well also, (a) 1, 1941, New International Harvester Truck, Chassis and Cab, complete with 1-CH2OO Bro oks!
