Yancey County, being of the
opinion that the Locust Creek
Schoolhouse and site upon
which it is located in South
Toe Township, Yancey Coun
ty, North Carolina, has become
unnecessary for public school
purposes, signed an order at a
special meeting on the 26th
day of May, 1952 directing the
sale of The Locust Creek
Schoolhouse and site upon
which it is located:
Therefore, by virtue of said
order and the power invested
in the Board of Education by
the laws of the State of North
Carolina, The Board of Educa
tion of Yancey County will
offer for sale at public auction
to the highest bidder for cash
at 11:00 o’clock a. m. on the
26th day of June, 1952 at the
courthouse door in Burnsville,
North Carolina, the following
described property:
FIRST TRACT: BEGIN
NING on a spruce pine known
as Potter’s corner and runs an
easterly course with D. N.
Robinson's line 45 feet to the
public road; thence a north
easterly course with public
road 11 poles to a planted
stone on the west side of the
public road; Whence a wester*
ly course 120 feet to a planted
stone; thence a southerly
course 11 poles to a planted
stone; thence an easterly cour
se 76 feet to the BEGINNING,

ceived by the Board of Educe*
tion of Yancey o<mnty in the
office of the County Superin*
tendent of Schools in the Yan
cey County Courthouse, Burns- *
ville, N. C., until 2:00 P. M.
Monday, June 23/1952 for fur
nishing all materials, labor,
tools, equipment and applian
ces for the construction of a
new consolidated High School
Building at Burnsville, N. C.,
at- which time and place they
will be publicly opened ana
read. *
Separate proposals will be
-received for general contract,
heating and accessories, plum
bing and accessories, and elec
trical installations.
Plans, specifications and
contract documents are open
to public inspection at the
office of Frank W. Howell,
County Superintendent of
Schools, Burnsville, N. C., or
may -be obtained from V. W.
Breeze & Associates, Archi
tects and Engineers, Shelby,
N. C., at any time before the
opening of the proposals, upon
deposit of $25.00. The full
amount of the deposit for one
set of documents will be re
turned to each actual bidder
submitting a bona fide bid,
upon return of all documents
in good condition within 5
day s after the date of opening
of proposals.
Each proposal must be ac
companied by a deposit with
the Board of cash or a certi
fied cheek, payable to the
Board, on some bank or trust
company insured by the Fed
eral Deposit Insurance Corpor
ation in an amount equal to
not less than 5 percent of the
proposal. In lieu of making the
cash deposit as above provid
ed, such bidder may file a bid
bond executed by a corporate
surety licensed under the laws
of North Carolina to execute
such bonds, conditioned that
the surety will, upon demand,
forthwith make payment to
the obligee upon said bond if
the bidder fails to execute the
contract in accordance with
the bid bond and upon failure
to forthwith make payment,
the surety shall pay to the
obligee an amount equal to
double the amount of said bid
bond. This deposit shall be re
tained if the successful bidder
fails to execute the contrac
within 10 days after the award
or fails to give satisfactory
surety as required by law.
The deposit will be returned
to the unsuccessful bidders
and to the successful bidder
upon execution of the contract
and performance bond.
The Board shall require the
person to whom the award of
any contract is made to fur
nish bond in some surety com
pany authorized to do business
in the State, or require a de
posit of Money, certified checi;
or government securities for
the full amount of said con
tract for the faithful perfor
mance of the terms of said
contract. .

No proposal may be with
drawn for a period of 15 days
after receipt of proposals.
General contractors are noti
fied that “An Act to Regulate
the Practice of General Con
tracting”, ratified by the Gen
eral Assembly of North Caro
lina on March 10, 1925 and as
subsequently amended, (Pub
lic Laws of 1937, ratified
March 23rd, Public Laws of
1949, ratified May 23rd), will
be observed in receiving and
awarding the General contract.
Plumbing and Heating con
tractors are notified that Pub
lic Local Laws of 1981, Chap
ter 52, and as subsequently
amended by Public Laws of
1933, Chapter 57, will be obser
ved in receiving and awarding

Awards will be made to the
