LEGAL NOTICE AN ORDINANCE AUTHOR IZING THE ISSUANCE OF _ $230,000 Ofc BONDS OF THE TOWN OF BURNSVILLE FOR THE IMPROVEMENT AND EN LARGEMENT OF THE WATER SYSTEM MAINTAINED BY THE TOWN. BE IT ORDAINED by the Board of Commissioners of the Town of Burnsville,as follows: Section 1. The Board of Commissioners of the Town of Burnsville has ascertained and hereby determines that it is necessary that said Town im prove and enlarge the system maintained ty the Townto pro vide a supply of water to said Town and its inhabitants by the construction of a water reser - voir together with the necess - ary water transmission mains including the acquisition and installation of the equip m e nt, machinery and apparatus re - quired for the use of such re servoir as part of the Tow n!s water system and the acquisi tion of the necessary lands or rights-in-land. Section 2. Said Board of Commissioners has also ascer tained and hereby determine s that the purpose hereinbefore described is a necessary ex pense of said Town within the meaning of Section 6of Ar ticle VII of the Constitution of North Carolina and is aprrpose for which said Town may raise or appropriate money, and is not a current expense of said Town. Section 3. In order to pro vide funds for such purpose, in addition to any funds which may be made available for such purpose from any other source, bonds of the Town of Burnsville are hereby author - ized and shall be issued pur suant to The Municipal Fi - nance Act, 1921, of North Carolina. The maximum ag gregate amount of bonds auth orized by this ordinance shall be Two Hundred Thirty Thou sand Dollars ($230,000). Section 4. A tax sufficiait to pay the principal of and in terest on said bonds shall be annually levied and collected. Section 5. A statement of the debt of said Town has been filed with the Town Clerk of said Town, as required by said Act, and is open to public in spection. Section 6. This ordinance shall take effect when approved by the voters of said Town at an election to be called and held as provided in said Act. The foregoing bond ordin ance was passed on the 31st day of July , 1970 and was first published on the 20th day of August, 1970. Any action or proceedings questioning the validity of said ordinance must be commenced within thirty days after its first publication. August 20,27.
