to not less than 5 percent of

a bidder may offer a bid bond
of five percent of the bid ex
ecuted, by a surety company
licensed under the laws of
North Carolina to execute such
bonds, conditioned that the
surety will, upon demand,
forthwith make payment to the
obligees upon said bond if the
bidder fails to execute the con
tract in accordance with the
bid bond, and upon failure to
forthwith make payment, the
