One of the neighbors repeatedly complained, but the man who maintained the pond only laughted and ridiculed the complaint. The neighbor brought a legal proceeding to abate what he call ed a' nuisance and to recover damages sustained by him to his crisps. ' The defendant contended that there was no cause of action be cause the geese were wild; that he did not own them; that they were in a state of nature; and that he was not responsible for what they did. He also argued that it was lawful for him to build a pond 6n,his own land and that if he feeds wild geese because of his love for wild things he was within his legal rights. This was an actual case which was, decided by the Supreme Court of .North Carolina in 1955. No simi lar case had ever before been de cided. . The Supreme Court said that the complaining neighbor had estab lished a cause of action against the defendant.
