In this instance, Motorola gave job applicant, Leon Myart, a test tp determine his fitness to work on the assembly line for television sets. Myart, a Negro, was refused a job after taking the test. He then filed a complaint with the Illinois FEPC alleging discrimination on facial grounds. The hearing exam iner ordered Motorola to hire My art because he thought the job test was obsolete and did not “lend it self to equal opportunitity to qual ify for the hitherto culturally de prived and disadvantaged groups.” Thus Motorola was told to aban don its tests.
