The driver of the car, his wife, the father of the drown ed family and one other man escaped without injury tom fhe car. Dead included Mrs. Mary Ida Kinsey, her nine year-old Son Terry, eight year-old daughter Theresa and six week-old Son Tony. Her husband is Roy Kin sey. Driver of the car was Wil lie A. Koonce and the male pas senger was Aaron Murrdll. All were of Trenton route 2. The car was headed eaStward ly on N.C. Highway 41 when in a long straight stretch it cross ed over to the left of the driv er, down an embankment and into the creek, where waiter was estimated to be about 15 feet deep. Divers Kenneth Brigman and Tony Kelly of the Kinston Fire Department Rescue Squad re covered the four bodies at about 7 a.m. The car plunged into the creek at about 3:15 a.m. Highway Patrolman C. W. Oakley has indicted Koonce on a charge of manslaughter. According to reports the group had been to Richlands Friday night to buy groceries and the men had stopped on the way back to “play pool,” causing the late hour returned toward their home. Heaviest Flooding In Many Years On Tap for Neuse The Raleigh weather bureau Wednesday predicted the heav iest flooding of Neuse River in 20 years as a result of heavy rains over the weekend which fell on every part of North Carolina. At 8 Wednesday morning the river at Kinston stood at 17.3 feet and the prediction is that it will crest somwhere between 21 and 23 feet early next week. Anything above 14 feet is con sidered flood state at Kinston. The weekend saw 4.35 inches of rain in Kinston and heavier rains in the Piedmont and west ern parts of the state. Quiet Session of Board on Monday The Jones County Board of Commissioners enjoyed a quiet session Monday, hearing routine reports from several heads and acting on the following mat ters: Tranferring $2500 from the school current expense fund to the school capital outlay fund; Transferring $2000 from the county general fund to the school capital outlay fund to permit purchase of another school bus; Authorized Sheriff Brown Yates to negotiate with an elec trician for some work needed to be done in the court house; Accepted the audit report on the county tax office, and pass ed a resolution supporting the $100 million dollars state school bond issue. Clerk Denies Motion in WiJcox Farm Litigation; Further Hearings Set Jones county Superior court Clerk Walter Henderson denied a motion this week for a “judgment by default and in quiry” in litigation between Nannie Wilcox McDaniel and several of h e r sisters against another two other sister sisters, Mrs. R. L. Fordham and Mrs. Matthew Moore, and their hus bands. The litigation which is over ownership of the farm of the late Steve Wilcox in Chinquapin Township has been in the local court for several years. Last year Judge Henry Stev ens granted a demurrer, filed by the Defendants, which would have ended the suit, but the state supreme court overruled Stevens and sent the case back to the Jones County court for further action. At the same time the defend ants filed their demurrer they also filed a motion to strike parts of the complaint, and this motion to strike sections of the complaint has never been act ed upon. The default judgment was sought on the basis that an ans wer had BOt been filed within Ete prescribed period set by law, but Henderson ruled that). She motion to strike, not hav- ' ing been acted upon, kept the ease alive, and barred judgment , under tthe time rule in behalf of the plaintiffs. Jones, a native of Lenoir Coun ty, was employed by the bank in Kistston until being transfer red some months ago. His trial is scheduled for the next term of federal court in New Bern. Not Guilty Verdicts in Murder and Mansaughter Charges Before ^eurt Two Suits Field by Paper Company for Collection of Debt Two suits were filed this week in Jones County Superior Court by the Albemarle Paper Com pany against George Mateja of Maysville, in which the compa ny seeks possession of logging equipment given as security and payment of the outstanding balance on two loans made to Mateja. One suit alleges a loan of $7, 500 with a balance of $4,725.93 and another loan of $7,650.25 with a balance due of $5,899.54. The suit further alleges that Mateja agreed to pay $75 per week on each loan but has made no payment on either since March 22 of this year. PFC BROWN AT FORT LEE PFC Robert J. Brown, 21, son of Mr. and Mrs. Robert H. Brown of Route 1, Pollocks ville, completed a 12 - week heavy equipment repair course at the Army Quartermaster School, Fort Lee, Va., Sept 29. Brown was graduated from Jones High School in Trenton in 1960 and attended North Carolina A&T College in Greensboro. Griffon Student Killed After Game Thirteen year-old David Al len Patrick of Grifton was kill ed shortly after the football game in Grifton last Friday night when he ran into the path of a car as he and the driver of -the car both were leaving the game. Investigating officers express ed the view that the accident was unavoidable insofar as the driver of the car, 20 year-old Della Alice Proctor, was con cerned. RACING ALLEGED Edward Earl Carter of Golds boro and Troy Lee Mills of Kins ton route 2 were booked in Kinston over the weekend and charged with racing and reck less driving. Glenda Collins Named President of Jones Central High Library Club By Cecil Banks The September meeting of the Jones Central Chapter of the North Carolina High School library Association was held Tuesday night iin the school li brary. The meeting was called to order by Mis. Marvin Thom as, school librarian and sponsor of the club. The main order of business was the election of officers for Three Marines Hurt At midnight Firday a car load of Cherry Point Marines ren into a ditch five miles east of Kinston on U.S. 70. The driv er, James Kennis, and Harold Vyse suffered serious injuries, Garrett Souce suffered painful but not serious injuries and the other two escaped without in jury. Kennis was indicted for driving too fast for existing roadway conditions. SUSPENDED SENTENCE Wednesday Superior Court Judge George Fountain sus pended a 9-month prison term for Camp Lejeunemen James Butler and James Rayburn, who pled guilty to stealing, a car in Kinston last month. Each was i ordered to pay the court costs. < the 1964-65 school term. The following officers were elected: Glenda Collins, President; Jim my Jones, Vice-President; Caro lyn Smith, Secretary-Treasurer; and Cecil Banks, Reporter. In addition to the election of the officers, the following com mittees were appointed: Cecil Banks, Alice Collins, and Paul ette Harrison, Publicity Com mittee; A. V. Spann, Melanie Hill, and Betty Canady, Social Committee; Jimmy Jones, Shir ley Humphrey, and Sandra Fin deisen, Program Committee; Glenda Collins, Rosemary Mal lard, and Vedys Black, Scrap book Committee; and Carolyn Smith, Carol Chapman, Geri Foy, and Rebbeca McGee, Projects Committee. The group voted to sell can dy to pay necessary expenses in attending the state conven tion next spring. The Club mem bers discussed coming events tor the year. The three jnajbr cases before Jones County S&perior Court last week ended happily, inso far as the defendants were con cerned. Tilmon Lewis was found not guilty of manslaughter in the auto death of Daniel Edward Conner on December 14, 1963. Ora Lee Bryant was found not guilty of murdering her hus band. And the grand jury refused to return a true bill against James Mills who was charged with rape. The longest prison sentence handed down by Presiding Judge W. H. S. Burgwyn went to A. J. Byrd, alias George Bald win, who drew 7-to-10 years for felonious breaking and enter ing. Four divorces, each on grounds of two years separation went to Alma Mayo Allen from Ronald Ray Allen, to Myrtle Greces Foy from Paul Foy, to James Gaskin Rodman from Bessie Viola Rodman and to Lossie Bell Fiori from Peter Fiori. Foy was also given 18 to 24 months in prison for not sup porting the 11 children of his marriage to Myrtle Greces Foy, two of whom had been born since he was ordered by the court to support the family in 1961. Another confusing domestic case judgment was that in the non-support charges against Milton Cleo Brock, who was charged with non-support of two children by his wife and three children he had sired on ano ther woman. The judgment was that he support the three chil dren away from home and the welfare department take care of his children by his wife. He drew a 2-year jail term suspend ed for 5 years on condition that he comply with this unusual judgment. Fined $100 for drunken driv ing were the following: Percy E. Evans, Paul Edward Davis, William James Metts, James Taylor, William Henry Britt, and Malvern Banks, who was charged with drunken driving was fined $100 for reckless driving. James Edward White was found not guilty of drunken driving but was found guilty of driving on the wrong side of the road but sentence in his case was deferred. Bruce Butler McArthur was also found not guilty of drunk en driving and the same charge against Cleveland Roberts was nol prossed. John Wesley Brown was giv en 18 months in jail for assault on a female and Bobby Ray Rob erts drew six months for public drunkenness and carrying a concealed weapon. George Walker was given 18 months for driving without a license but the jail term was suspended on condition he not drive a car for five years. Judgment was suspended on John Andrew Jones for an as sault charge. A charge of driving while lic ence was revoked against Mar vin Mills was nol prossed, as was a speeding charged against Frederick Keller, a liquor viola tion charge against George Mit chell, and a speeding charge against Tommy Hill Jr. Horace Cleveland Morris was fined $10 for speeding. Judge Burgwyn also fined two jurors, Horace Quinn and William Wiggins, $25 for not showing up for court, but or dered that the fines be strick en if they produced medical cer tificates supporting their ab sence.
