A pleading seeking relief against you has been filed in the above entitled Special Pro ceeding, which has been com menced in accordance with Chapter 156, Subchapter 3 of the General Statutes of North Carolina. 2. That it has been made to appear to the Court by affidavit, that the names of the owners of the whole or a share, of tracts of land, which is the subject mat ter of this Special Proceeding, are unknown, and can not, after due diligence, be ascertained by the petitioners. 3. That the nature of the re ' lief being sought, is as follows: To establish a drainage dis 1 trict, the general area of the 1 boundaries of the proposed > Drainage District is the Water ’ shed of Moseley Creek-Tracey ' Swamp, located in Lenoir, Cra 1 vep and Jones Counties, and - which empties into Neuse River 1 between Fort Barnwell and Kin ! ston, the specific boundaries of 1 the proposed Drainage District ■ being setforth in said Special Proceeding. 4. The substance of the peti tions filed in this proceeding ' for the purpose of asking the 1 Court to create the said drain ' age district, is: (1) that the drain l ways of Moseley Creek-Tracey 5 Swamp and the laterals thereto are clogged and do not provide ■ sufficient drainage for the lands within the watershed, (2) that 1 the general health of the com h munity has been adversely ef fected because of the poor drain K age ui auiiaue watci wiuuu me watershed, (3) that there have been major crop losses as well as damage to woodsland, with in the boundaries of the water shed, because of the insufficient drainage of surface water. 5. The general descriptions of the several tracts of land as to which the owners of the whole or shares therein are unknown, is described with particular reference to the map on file in the above entitled proceeding, which shows the location of the several tracts of land together with the number of the tract. The general description cites the number of the tract of land, as shown on said map and in said proceeding, and reference is made to said map and pro ceeding for a more complete de scription of the said property.
