There was a law he didn’t like, s6 he said the hell with it and broke it. And, too, 1 read about a, clergyman who didn’t -like the'* draft law so he leads the way into the court house, gets the files,, takes them out and burns them. See, what I mean? Somebody is nuts, Cal or Spock or the priest. Jf Spock gets by and the priest is acquit* ted, what does that mean? Does it mean that in the future peo ple will only obey the laws they like? I suppose so. In fact, I know so, because I have just read an article by Abe Fortas in the New York Times about 'how far people can go in civil disobedience. Fortas, as any good Johnsonian knows, is the new Associate Justice of the Su preme Court of the United States. This is about as high as you can go up the jurisprudence pole and live. This means that, by old Blackstone and White Rock, he is about the last word in law. You would think right off that he would be a devoted follower of law to the T. But no. Read this quote from the article: “If I had been a Negro living in Birmingham or Little Rock or Plaquemines Parish, La., I hope I would have disobeyed the state j laws that said I might not enter j the public waiting rooms reserv ed for ‘whites.’ I hope I would have had the courage to disobey, although the segregation ordin ances were presumably law until I they were declared unconstitu tional.” I That is the highest word you i can get on justice in the United States, mind you. That means, of course, that a i man has a right to interpret his own laws; a right to decide on what laws to obey. It is a silly law which keeps me from buy ing a drink in a West Virginia restuarant while if I were in New York City I could have my libation. There’s a law in this state which says that a merchant can’t sell certain items lower than a set price. What kind of a law is that! The merchant should disobey the law? According to Fortas and Spock and the priest, yes. But I say no, and the gen eral public says no, because when people decide what laws they like, anarchy is born. There used to be a saying, now extinct, that “your liberty starts where my nose ends.” Re member? No more. The students who illegally occupy campus buildings, at the approval of Fortas, Spock and priest, keep one student or many students from doing what he came to that campus to do. In Chapel Hill in the winter, a student picked me up in his car, and we talked about student rights and usur pations. He didn’t approve of any campus laws, he declared, became laws were made to fet ter the masses. He stopped at a red light. I remarked that that light was a law and why did he obey it and he looked at me as if I were a nut, and said, did I want him to get a part of his anatomy knocked off. And that, . of course, explained everything. Do you agreo with that? A: That phrase, “equality of opportunity”, is a cliche that means little unless it is carefully defined. If the same opportunity is £ven two people — one an able person, the other a dullard — the two situations are not equal. If you gave a six-month -old boy and a physically able man each the opportunity to own 20 pounds of gold if he proved to carry it 100 yards, the opportunity to do so would be the same h ■ it would not lie equal. It would be mope accurate to say that we should give every man an opportunity commensur ate with his ability; and opport unity and ability may be quite different. There would be no need to accuse the Negro of lack of ability or interest if we tested his abilities, first. Q: Dr. Garrett, Liberals team always to apply tha word "pre judice" to any statement with which they do not agree. Is that your impression? A; I am afraid it is. The term “prejudice” means pre-judg ment, and implies a judgment in advance of the facts. In racial matters, prejudice carries the idea of dislike or even hate for some racial group. Thus, a man prejudiced against Negroes would be one who dislikes all Negroes because they are Ne groes. Southerners are rarely so prejudiced and their attitude toward the Negro is not pre-de termmed. In many, perhaps most cases the term preference is what is really meant by the Liberal who uses, instead, the word “pre judice”. Both Negroes and Whites usually prefer their own groups; there is no prejudice in volved. When you are called “prejudiced”, challenge your critic to demonstrate whether lyour attitude is a pre-judgment, not based on facts, or whether it i is simply something with which he does not agree.
