1 --- The ever-expanding demands of traffic are forcing the widening of \fcrnon Avenue* In Kinston to four lanes. Some off the houses in the way are being moved beck on their Ms. Others, such as the one shown hero moving south on NC 55 at King Street bridge Tuesday -after noon didn't have room to stay at home, so it's off to a new address._ „; ~ " New gun-control legislation is scheduled to be considered by the Senate when it reconvenes next month. ^ v , ' Earlier in the session, the Con gress cleared for the President’s signature an omnibus crime con trol bill which contained provis ions regulating the acquisition and possession of handguns and certain other firearms. This Act was Signed by the President and became the law of the land. I supported this Act. This measure was well along toward passage when the tragic assassination of Senator Robert P. Kennedy took place and brought a flood of apeals-io Com gress to add very stringent re strictions over the sale and use of firearms. I have received thousands of letters from North Carolinians in recent weeks giv ing their* views on the subject of gun-control legislation. For this reason, it seems ap propriate to call attention to the gun-control provision* of the Safe Streets and Crime Control Act of 1068. It outlaws mail order shipments of pistols and compels those who wish to pur chase pistols to buy them from local dealers who can readily ascertain their eligibility to pur chase tlpwffS, of a; has: [bits the acquisition and p of pistols, rifles, shot or other firearms by any who has been convicted ; or who is under in a felony, or who any state to avoid a feldhy; or who rhentaiUy in every importer, manufacturer, or dealer in firearms to obtain a license from the Secretary of the Treasurer to keep a record of the names and address of ev ery person to whom they sell any firearm of any character! On July 24th, the House pass ed and sent to the Senate its version of the new long-gun leg islation. Under the House hill there would be a Federal ban against mail-order and most out of-state purchases of rifles and shotguns and the interstate ship ment of handgun ammunition.. On the same day, the Senate judiciary Committee approved gun controls similar to the House - passed provisions. Nei ther measure, however, requires the registration of firearms or the licensing of gun owners which some have Congress to do. The Senate Judiciary Commit tee measure would extend the ban on pistols imposed by the recently enacted Safe Streets and Crime Control Act to rifles and shotguns and compel those who desire to purchase rifles and shotguns to obtain them from a local dealer in the state of i their residence or in an ad joining state. I expect to support this proposal when it comes be v ——__— -—L— fore the Senate. I have spent many years of my life as • trial lawyer and judge, and have never known of a single case where the con viction of file accused depended upon any registration or iden tification of a firearm. Moreover, there is grave doubt in my mind as to the constitu tionality of such a Federal law. The States have the power to pass laws of this nature. Wheth er they do so, is, of course, a matter for them to 'decide.
