Bar Association) MOTOR VEHICLES May a person be guilty of a crime if he is driving his car upon an open highway less than fifty five miles an hour ? Yes. There are numerous of fenses that the driver of a motor vehicle may be guilty of while driving within the speed limit foi the particular area. One of the most common offenses is that of “reckless driving.” The statutes of North Carolina provide: “Any person who drives any vehicle upon a highway care lessly and heedlessly in wilful or wanton disregard of the rights or safety of others, without due cau tion and circumspection and at a speed or in a manner so as to en danger or be likely to endanger any person or property, shall be guilty of reckless driving.” May a person be cinvicted of any offense if he is driving his car at a slow rate of speed ? Yes. There is a statute which provides: ‘‘No person shall operate a motor vehicle on the highway at such a slow speed as to impede the normal and reasonable move- g ment of traffic except when re- » duced speed is necessary for safe y operation because of mechanical * failure or in compliance with law; g provided, this provision shall not S apply to farm tractors or other g motor vehicles operating at reas- S onable speeds for the type and g nature of such vehicles.” 1 Are persons riding or driving g animals upon the highway subject s to the provisions of the Motor Ve- f hide Code? 8 Yes. There i> a section of the g Motor Vehicle Code which says: J "Every person riding an animal 9 or driving any animal drawing a £ vehicle upon a highway shall be 5 subject to the provisions of this 8 article applicable to the driver of 5 a vehicle, except those provisions _ of the article which by their na ture can have no application." Is coasting upon the down grade 1 of a highway illegal ? Yes. It is unlawful to coast upon the down grade of any high way with the gears of the vehicle „ in neutral. Is it illegal to equip an auto- 0 mobile with a television? A 1949 statute says no person u shall drive any motor vehicle with n a television viewer, screen, or oth er means of visually receiving u television broadcast which is lo- ci cated in the motor vehicle at any n point forward of the back of the ii driver’s seat, or which is visible to - the driver while operating the mo tor vehicle.
