DOGS
Is the owner or keeper of a dog
liable for the damage it does?
Section 67-1 of the General Sta
tutes of Xorth Carolina provides:
“If any dog, not being at the time
on the premises of the owner or
person having charge thereof, shall
kill or injure any livestock or
fowls, the owner or person having
such dog in charge shall be liable
for damages sustained by the in
jury, killing, or maiming of any
livestock, and costs of suit.”
It should be carefully observed
that the above statute refers only
to “livestock or fowls.” It says
nothing about bodily injuries to
one’s own person or damages to
property other than “livestock or
fowls.” The particular statute,
although enacted in 1911, has nev
er come before the North Carolina
Supreme Court for an interpreta
tion.
The civil liability of dog owners
is found in the common law or the
decisions of the court.
The most recent dog law appears
in Pegg v. Gray handed down by
the Supreme Court of North Caro
lina in 1954. In an opinion writ
ten by Justice Jeff. D. Johnson,
Jr., evidencing both a practical and
legal knowledge of dogs, the court
said: “It may be conceded on a
well-established principle of law
that where a dog roams abroad on
another’s land of its own accord
and does damage or inflicts injury
to persons, animals, or property
there can be no recovery therefor
in the absence of special statutory
enactment, unless it be shown that
(1) the dog was possessed of a
propensity to commit the depreda
tion complained of and (2) the
owner knew, or was chargeable
with knowledge, of such propensi
ty.”
"This principle of law is ground
ed upon a recognition that by na
tural instinct and habit an ordi
nary dog of most breeds is in
clined to roam around and stray at
times from its immediate habitat
without causing injury or doing
damage to persons or property.
And in deference to this natural
instinct of dogs the processes of
the early common law eschewed
the idea of requiring that they be
kept shut up, and instead promul
gated the foregoing rule which al
lows a reputable dog a modicum
of liberty to follow his roaming
instincts without imposing liability
on its master. And so, since early
times the law has been and still
is that the owner of a reputable
dog is not answerable in damages
for its entry upon the lands of an
other upon its own volition under
circumstances amounting to an un
provoked trespass.'”

Safer Childbirth
In a recent ten-year period the
maternal death rate dropped
dramatically. The greatest re
duction came about in the realm
of infection. Other improvement*
were in the better control of hem
orrhage, effects of anesthesia,
and loss from heart disease.
Antibiotics unknown some
years back have helped the ob
stetrician in his victory over in
fection. They have also made the
cesarean operation safer. Im
proved use of hormones can now
shorten difficult labor. And better
x-ray examinations have been de
vised by radiologists to examine
the mother where necessary be
fore birth “to be sure the passen
ger will fit the passage,” as one
specialist in radiology has
phrased it. Not only is this kind
of advance information helpful
to the mother but, by forestalling
possible birth injury and poten
tial periods when the arriving
baby is cut off from oxygen, may
be a godsend to the baby.
Other medical techniques
which help the delivering mother
are more frequent use of trans
fusions because of an improved
blood bank system and better
methods of anesthesia, with a
greater call upon the services of
the anesthesiologist.
Perhaps the most serious com
plication of pregnancy is a baf
fling disorder known as eclamp
sia or toxemia, in which the body
retains too much sodium and
gives off too much of other sub
stances that should not be lost,
such as protein thrown off in the
urine. Toxemia’s cause i3 un
known. Today, if it is detected
before the sodium losses and oth
er blood imbalances produce con
vulsions and coma—and this is
one good reason for early and
regular prenatal care—it can
usually be brought under control
Is the owner or keeper of a dog
liable in trespass if he sends or
allows his dog to go on the land of
another in pursuit of game?
Yes. The Supreme Court ol
North Carolina expressly so ruled
in the previously mentioned case
of Pegg v. Gray.
In the particular case, a pack of
seven to ten foxhounds of the de
fendant on numerous occasions
chased foxes onto and across the
plaintiff’s land without his per
mission and in disregard of his
protests. They damaged growing
crops and stampeded a herd of sev
enty beef cattle which in turn dam
aged the fences. Although the
[ hunter himself did not enter the
plaintiff's property, it was held
that he could be held responsible
on the theory of trespass for the -
damage done by his dogs.
