Mrs. Josephine Hold who has been visiting relatives in Raleigh for the past three weeks returned to Shelby Thursday. When the Sultana, prison ship, sank near Memphis in the Mississippi River. April 2), 1865, the Tennessee Federal sol diers who were saved in tha dis aster, which cost 1,828 lives, de cided to hold an annual reunion. The 81-year-old veteran is now the sole survivor. Raleigh.—The supreme court re fused a new trial in a capital cas; tor the seventh time during the spring term when it found no error in the sentence that JUpes Spivcv of Lee county be electhseuted for the murder of Betty Spivey, to whom he proposed marriage. The supreme court .Was granlrl two new trials this term to pere-rs 1 sentenced to death and the- nine capital cases it has considered is be ■ lieved to be a record for cue term. Betty Spivey was killed with an axe on the night of September 21, 1929 in a cow barn shortly c.'ter Spivey, who was calling on o? and she had left the house thinking that some one was at tempting to steal a cow. Evidence was submitted that the girl a few minutes before had show n her caller a pair of hose the comt opinion said, which she "teasinply j told James Spivey had been give.) to her by another fellow." : The coroner testified that the girl had been criminally attacked. Spiv ey did not take the stand during his trial. His electrocution date was au.o* matically set for May 23. “Would you be willing to support the constitution?” was asked as a last resort by the census taker at Columbus.
