Shaliotte BY DOUG RUTTER Shaliotte Aldermen last week reversed an earlier interpretation of town code and granted a building I permit to a businessman anxious to rebuild. Iiuc (jciiiui was requesiea Dy rsiuy Tripp for a retail store to be built on property in the old Lewis Shopping Center on U.S. 17, which burned about two years ago. During a special meeting last Thursday, aldermen followed a recommendation from the planning board and voted unanimously to grant the permit. Board members Jody Simmons and Paul Wayne Reeves were absent. At its last regular meeting, the board decided it would not grant a permit until it saw plans for the entire plaza. Aldermen first discussed the matter dnrinP their .Tnlv 90 meeting. At that time, they sent it to the planning board for review. During a special Aug. 8 meeting, the planning board discussed the matter for an hour before recommending the permit be granted. In the I Suspect Charged At Holden Beach Holden Beach Police last week charged a Supply area teenager with possessing stolen goods. According to an arrest warrant on file at the Brunswick County Clerk of Court's office, Mary Carrington Holmes, 17, of Route 3, Supply, was charged last Wednesday with possessing $400 worth of clothing that had been stolen from a victim identified as John E. Gaspari. Ms. Holmes was released from custody last Wednesday without having to post an appearance bond. Her trial date was scheduled for Aug. 17 in Brunswick County District Criminal Court. f ? ? iviiacu opi iiiyer Up For Adoption A female mixed springer spaniel is among the pets recommended for adoption this week by the Brunswick County Animal Shelter. Board Grc end, the feeling of both boards was that Tripp spent nearly $50,000 for the property and should be allowed to rebuild his shop as it was prior to the fire. Debate over the building permit stemmed from a town ordinance which addresses setbacks in commercials districts. Two sections of the ordinance contradict one another?with one requiring sideyard setbacks and the other requiring no side-yard setback. "I don't know who drew it up or who passed it but it doesn't make sense," Alderman Wilton Harrelson said prior to making the motion to grant the permit. "I think it's time for common sense to prevail over the law." Also inellldpH in his mntinn 1UQC O request that a letter be sent to Tripp Sloan, one of the principles in C&S Developments which owns the shopping center land, stating that no more building permits will be issued for the project until the developers submit a "master plan." In May, aldermen agreed to follow one section of the ordinance which requires side-yard setbacks of at least 10 feet in addition to larger front and rear setbacks. The section of ordinance endorsed last week, however, does not require any side-yard setback as long as there is access to the back of the building by a rear street or an alley along one side of the building. Town Attorney Mark Lewis advised the board that under that interpretation, Tripp could be granted the permit. Plans for a retail shop which was to be built just two feet inside a side property line prompted the board's earlier interpretation of the ordinance. The building permit for that project was later revoked, according to Building Inspector Albert Hughes, because concrete was poured prior to a request for a footing inspection. "This is a great opportunity for our much-needed volunteer recruitment officers in rescue and fire to learn more about how to sell their resources to volunteers and recruit more of them from our county," added Cecil Logan, Brunswick County Emergency Management Coordinator. He is urging all fire and rescue units to have someone present at the workshop. To register, call the VIC office at 253-4441. Je Seasonable was 81 degrees, which Canady said was one degree above normal. The daily average high temperature was 88 degrees, and the daily average low temperature was 74 degrees. The maximum high temperature during the period was 90 degrees, occurring on Aug. 11. The minimum low temperature was 70 degrees, occurring on Aug. 13. Although Tripp's permit was granted, board members agreed during last week's half hour meeting that the existing ordinance has to be reworked and another ordinance needs to be drafted relating specifically to phased projects such as shopping centers. Lewis recommended that special guidelines be adopted for dealing with shopping centers. In the event the plaza will have multiple owners, as has been proposed for the reconstructed Lewis Shopping n?*? v^ciuur, ne saia me town should require developers to bring a master plan to the board and sign an agreement binding future owners to comply with that plan. Firewalls are now required under the state building code but are not mentioned at all in town ordinances. Board members agreed that the town code should address which business is responsible for which firewall where there are adjoining but independently-owned structures.
