OCEAN ?CITYl Chevrolet - Geo Hwy. 17, Bolivia 253-5221 Southport 457-9547, Wilmington 762-7225 Mother Claims Negligence Caused Son's 1989 Death The mother of a 13- year-old boy who was accidentally shot and kil led in 1989 is suing the Southport family whose home is where the shooting occurred. Bernetta Moore filed a lawsuit in Brunswick County Superior Court claiming negligencc caused the death of her son. Warren Christo pher Moore, on Nov. 15, 1989. She is asking that a Brunswick County jury award her in excess of 510,000 and other relief to help pay for funeral bills and medical bills incurred from the shooting. According to the lawsuit, Moore was staying at the home of a friend, Garland Hankins, 17, of Jabbertown Road, Southport, when the acciden tal shooting occurred. Hankins and his parents, Carolyn and Harold Hankins, and another person who was staying at the home, Eugene Gore, have each been listed as de fendants in the complaint filed by a Greensboro attorney, Lee Andrews. The complaint states that Garland Hankins was "ncgligcnUy cleaning or playing with his gun" when it ac cidentally fired, hitting Moore in the side. The Brunswick County Sheriff's Department filed no charges in the shooting. According to the investi gating officer's report, Moore was hit by pellets from a 12-gaugc shot gun around 3:30 p.m. on Nov. 15. The victim was found lying in a rear bedroom of the home and was dead at the scene when officers arrived. The lawsuit claims Hankins was negligent by failing to keep proper care of and control of the gun and by operating and cleaning the gun in a careless and reckless manner. It claims Carolyn Hankins, Har old Hankins and Eugene Gore were each negligent in not supervising Garland about safely, use and care when handling a gun. The com plaint states that the Hankinses pur chased the gun and ammunition for their son without providing instruc tions about care for the safety of others. Moore was survived by his moth er and father, Walter Bellamy, and three sisters, the complaint states. As a result of his death, the family has been deprived of their relation ship with Moore and the income which he could have been expected to spend on his mother and parents, it continues. The funeral bills and medical ex penses are of an amount to be prov ed at the trial, according to the doc ument.
