Real Esiatc Commis sion has reprimanded and revoked the liccnsc of a former local devel oper and real estate broker for al legedly selling lots without disclos ing thai they had been used as col lateral on bank loans. The Commission, in a consent or der signed May 24, revoked the North Carolina broker's liccnsc of Allen W. May of North Myrtle Beach, S.C., effective June 17. The action came in response to a complaint filed by Linda Pcclc Cox, a resident of Shell Point Recreation al Village, in December 1990, Mrs. Cox wrote the state Attorney Gcncr 2! < Office, W^irh rrfrru'd tl'lC COI1V plaint to the Commission, said Thomas Miller, assistant attorney general and legal counsel to the Commission. Since May had allowed his real estate liccnsc to expire on June 30, 1983, the Commission's action has no immediate effect. However, Miller said the revoca tion would affect May's ability to reapply for a real estate broker's li ccnsc in North Carolina. When an individual allows their liccnsc to lapse, he or she can usual ly reapply for reinstatement. North Carolina courts have ruled, said Miller, that during thai in-between period they arc still subjcct to the state's real estate licensing regula tions. Otherwise, someone could lei their liccnsc expire to avoid disci plinary action, then later seek rein statement. According to the Commission's conscnt order signed by Phillip Fisher, cxecuuvc director, the cor poration was engaged in die sale of residential lots by means of install ment sales contracts between 1976 and 19X8. Wncn May fell behind on loan payments. United Carolina Bank began foreclosure proceedings on the lots used as collateral. After the nature of the situation was disclosed, the bank worked out an agreement w ith a group of affect ed property owners and their attor ney in which the bank would not sell lots on which the property own ers were up to date on installment payments to May. "The results were pretty phenom enal," said Miller. "They were for tunate things worked out so well and they didn't lose everything. UCB took a pretty go<x1 attitude." "I've not dealt with then, in about eight years." Ol the Shell Point Recreati- nal Village land sales dispute. May said, "It's been resolved. We settled that a long time ago."
