Suspect Charged In Moonshine Raid Must Forfeit His Truck A Chadbourn man arrested fol lowing die seizure ul (>() gallons ol lead -ton lam inalcd i)HN)nshine in Brunswick County m July must lor leit his pickup truck to the N.C. Alcohol Law Enforcement Agency. Another deletulanl arrested in the sting had all charges voluntarily dis missed against him in Brunswick County District Court last week. Shcrrill Minson Tart, ol Route 2, pleaded guilty to (X)sscssion ol non tax paid alcoholic beverages. Six other charges against him were vol untarily dismissed, including con spiracy to to sell non-tax paid alco holic beverages, selling non-tax paid alcoholic beverages, transport ing non-tax paid beverages and ille gal manufacturing of liquor, all mis demeanors. Tart was one of five people charged after ALE officers seized the moonshine that had been transported into Brunswick County. Officers had previously seized 20 gallons ol the illegally-distilled corn whiskey but never discovered where the moon shine was manufactured. Tart was sentenced to six months in jail, suspended for two years and ordered by District Court Judge Jerry A. Jolly to pay court costs and S250 in restitution to the prosecut ing witnesses. He was ordered to remove per sonal property from a Ford pickup truck that was seized in the case, for it is to be turned over to the ALE office. Stale agencies can auction property seized in such cases, with proceeds divided among participat ing law enforcement agencies. The Wilmington ALE office was assisted in the investigation by de tectives from the Brunswick County Sheriff's Department. Tart was also ordered not to vio late any laws for two years. The moonshine seized in the case was ordered destroyed. Another defendant, Steven Shcr rill Tart 11. of Route 2. Chadboum. had all charges dismissed against him. lie had been charged with sale of non-tax paid alcoholic beverages, possession of non-tax paid bever ages. transporting non-lax paid bev erages and conspiracy to sell non lax paid beverages. The arrests were the result of an on-going investigation that began April 26 and culminated with the arrests in July. Agents later learned that the moonshine contained potentially lethal amounts of lead, possibly from lead pipes used in the distilling pro cess. They warned county residents to not drink any moonshine. Judges Jolly, Napoleon B. "Poli" Barefoot Jr. and D. Jack Hooks Jr. heard the following cases in District Court Nov. 4-6: Donna W. Babson, simple worth less check to Wilsons for S32.24 and S28.33, both voluntarily dis missed, checks paid. Corey E. Benton, larceny judg ment, prayer for judgment contin ued and costs, not go back on the premises of Wilsons without their permission.
