CP&L Will Pay $125,000 Penalty For NRC Violation Carolina Power & Light Co. will not protest a S125.WX) civil penalty proposed lor violations of NRC re quirements at the Brunswick Nuclear Plant near Southport, spokesman Elizabeth Bean said Monday. She said the utility will work with the NRC toward greater com pliance with the federal regulatory agency's requirements. NRC spokesman Ken Clark said that the civil penalty ? nearly three times the usual S50,(XX) fine in such instances? was being proposed be cause of two situations in which it says CP&L took inadequate actions to correct previous violations con cerning work control and indepen dent verification procedures. "We recognized the violation and so we're not going to contest it," said Ms. Bcan.Thc penalty was levied after the NRC investigated the October shutdown of the Unit 1 rcactor. The reactor was shut down when a worker incorrccdy set the timing on a piece of equipment used as a back-up power source. The NRC found that a mainte nance mechanic had adjusted air in take valves on a uiesel generator without using a required mainte nance instruction and without super vision by management assigned to the activity or quality control over sight. Another incident that same month involved a valve that was not prop erly aligned and a lack of indepen dent verification of its alignment by another operator. An NRC official discovered the problem. On May 31. 1991, the NRC pro posed an S87.500 fine against the company for similar problems. Eonctcr, administrator of the NRC's Region II offiec in Atlanta, said the violations indicate that corrective actions to address the previous simi lar violations have been adequate. The base civil penalty for the cur rent alleged violation was S5(),(XX). However, Clark said it was in creased to $125, (XX) bccausc it was the NRC which identified the first violation and the second was discov ered as a result of troubleshooting abnormal dicscl generator operation. It was also increased bccausc of past performance, noting that previ ous corrective actions for similar problems have not been effective. CP&L has 30 days from receipt of the notice of violation in which to either pay the civil penalty or to protest it in whole or part, said Clark. The fine will not add to con sumers' electrical costs. Money for paying the penalty comes from shareholders' funds. Ms. Bean said that while the penalty situation is an indication that there are more improvements to be made, that CP&L lias seen some im provements at the plant during 1991 Among those are a reduction in radiation exposure for workers from one of the highest levels in the in dustry to below the national average, she said. Others include fewer events of the type that must be re ported to the NRC, a reduction in the number of activations of safety systems and "excellent" scores by operators on their rcqualification ex ams. "We've seen some improvements, but wc still have a ways to go," she said.
