Seminars Set April 7-9

South Brunswick Islands Chamber Of Commerce
"The Gathering" in Raleigh last week was a huge success. There
were at least WX) people in attendance. The food w;ls out of litis wuriu
and we had a reggae band playing music of the
"Islands," just perfect.
Thanks to all the hoard members and volunteers
who attended. The South Brunswick Islands made a
big spiash in my old hometown, if they didn t know
who we were, they sure do now.
Many things are coming up in the "islands" for
you folks here at home. First we have our Customer
Satisfaction seminars April 7 and 9. We want to help
you keep your customers happy and shopping at
home with you. The seminars arc co-sponsored by
our chamber, the Southport chamber and the Small RICHARDS
Business Administration at Brunswick Community
College. I'd like to especially thank Vclva Jenkins for working very
diligently with me on this project. I'm sure these seminars will be a big
success. Call the college if you would like more information.
Also we want to give you the opportunity to thank your employees
on Professional Secretaries Day. We're encouraging all employers to
bring their administrative, clerical and support people to the luncheon
April 22 at Sea Trail. The cost is a minimal S10.00 per person. We're
having a fashion show courtesy of Victoria's Ragpatch and music cour
tesy of my morning radio partner Lee Michaels. All in all, we should re
ally have a great time. Debbie Rupp and her committee are putting the
finishing details on the luncheon and I can't wait.
Next on the calendar is our own "Gathering." Our Business After
Hours is on April 30 and it's hosted by The Gauntlet Golf and Country
Club at St. James Plantation. Never been out to St. James? Now's your
chance. It's just beautiful and we're looking forward to their hosting the
event.
I hope to see you all at cach and every one of the things your cham
ber has planned for you. Remember, it takes participation by you to
make these events a success.

U.S. Judge Dismisses Co-ops'
Antitrust Suit Against CP&L

A federal judge ruled lasi week
iliat Carolina Power & Light Co. did
not violated antitrust laws when it
refused to sell a portion of its Bruns
wick nuclear plant to a group of
electric co-operatives.
The original suit was filed 15
years ago by the North Carolina
Electric M'. <nticiship Corporation
(NCEMC) on behalf of 16 EMCs,
including Brunswick Elcctric Mem
bership Corp. (BEMC).
It sought more than S300 million
in damages, a figure that has since
been updated to closer to SI 5 mil
lion. Damages can be trebled under
antitrust laws.
Filed under the Sherman Act, the
suit sought the damages from an al
leged 50 years of "exclusionary con
duct by CP&L" that it said had pre
vented NCEMC from building a
generating and transmission system
and prevented the distribution co
ops from obtaining "elcctric inde
pendence" from CP&L.
After hearing the cooperatives*
case, U.S. District Court Judge
Frank Bullock dismissed the suit be
fore the matter could go to the jury,
granting CP&L's request for a di
rected verdict.
He ruled that NCEMC had failed
to present evidence that CP&L had
violated antitrust laws in its dealings
with NCEMC. He said that the an
titrust laws do not require CP&L to
sell an interest in any of its assets,
regardless of whether it had refused
to deal with the co-ops.
"We hope that the court's deci
sion will finally put this lengthy and
expensive matter to rest," said
Richard E. Jones, CP&L senior vice
president and general counsel in a
news release. "We have been confi
dent over these long 15 years that
this suit would be decided in our fa
vor. We're extremely pleased with
the court's ruling."
David J. Batten, general manager
of BEMC and a member of the
NCEMC board, said the 16 co-op
plaintiffs are to meet with NC
EMC's general counsel, Thomas J.
Bolch, March 31, to discuss the de
cision and the possibility of an ap
peal.
NCEMC had negotiated in the
1970s with both CP&L and Duke
Power to buy into nuclear plants be
ing built by the two utilities.
NCEMC now owns part of Duke's
Catawba plant, but could never
reach an agreement with CP&L to
buy part ol the Brunswick plant at
South port.
The 1977 suit alleged numerous
refusals by CP&L to deal with the
co-op association regarding ex
change of power through the re
gion's transmission system.
Last October, Judge Bullock de
nied the investor-owned utility's re
quest that the case be dismissed out
right.
He ruled the case could go to trial
on a number of the co-op group's
anti-trust claims, but dismissed its
accusation of "predatory pricing," a

claim that CP&L sold electricity to
the cooperatives at such a cheap rate
that they could not afford to build
their own power plants. The co-ops
had contended the utility sold power
at below cost 19 EMCs during the
1950s and 1960s, making it not fea
sible for them to build their own
generating facilities and making it
impossible to obtain financing from
the Rural Elcctricificalion Admin
istration for that purpose.
Bullock also had the EMCs recal
culate alleged damages before the
case went to trial.
Batten said that had the jury been
allowed to hear the evidence, its
members could have determined
that CP&L violated the antitrust
laws.
The co-ops estimated they had
suffered injury to the extent of S415
million, or about 8 percent of the
cost of wholesale power purchased
by the co-ops from CP&L during
the period in question.

place.
The trial began Feb. 25 in Greens
boro in the U.S. District Court (or the
Middle District of North Carolina.

16(b)(2) Application to be submitted to the North

utilizing vans. The total amount requested for
administrative, operating, and capital assistance for
July 1, 1992 through June 30, 1993 includes $76,160
in federal funds and $16,320 in state funds. The local
matching share is $16,320. The application may be
inspected at the Brunswick County Planning Depart
ment, US 17, Bolivia, North Carolina, from 8:30 a.m.
to 5:00 p.m.
