Forum On Easement Policy Opens Marine Expo in Wilmington Today A forum today (Thursday) on the impact of a pro posed state public trust casement policy on marine busi nesses opens the N.C. MarineExpo Trade Show and Conference in Wilmington. The conference runs through Saturday at the Wilm ington Milton and Coast Line Convention Center and is open only to representatives of the marine industry It offers an array of seminars on topics such as waste man agement. bottom washing, and marine iasurance. Today's forum is set for 1 1 a m to 12:30 p.m. in the Wilmington Milton Ballroom. Mike Bradley, director of the N.C. Marine Trades Program at UNCW, will serve as moderator for Ihc 12-person panel and audience dis cussion The forum offers an opportunity few those in the ma rina and other marine-related businesses to discuss a plan proposed by the state to impose lease or easement fees and terms on marine businesses with boat slips. Until recently North Carolina has not required ease ments for docks, piers or marinas extending into public waters, though il has required casements for certain oth er commercial or private uses According to a news release, the casement/fee pro posal has sparked controversy in part because of the be lief among some marine businesses that it would put them at an unfair trade advantage with similar concerns in neighboring stales While some other stales charge marinas for easements, neither South Carolina nor Vir ginia do In Walker v. Coastal Rcvmrces ( 'ommission, Ihc N.C. Court of Appeals determined that construction of some private facilities in public trust waters cannot be permitted without easements from the state. The case in volved a marina with approximately 150 slips encircling about six acres of public trust waters ? waters held in trust by the state for public use and benefit. The court ruled it improper to issue a C'AMA permit for develop ment in Oriental harbor without an easement from the state. Under current state law. easements or other interests in state property must be conveyed for fair market value except to certain public grantees such as local govern ments and to private entities not operating for a profit. The state Department of Administration and Department of Environment. Health and Natural Resources (DEHNR) have begun work on a system for evaluating, charging and collecting payments for projects that make private use of the submerged lands of the state or other wise have a signficant impact on public trust waters. According to a DEHNR memorandum, (he goal is to protect public trust w aters and ensure a fair return on use of the state's public lands for commercial purposes, while not unduly slowing development that is consistent with public trust doctnnc and C'AMA. and for which the developers arc willing to pay a fair price.
