RECORDER'S
COURT
In Recorder's' Court on Tuesday
the case against W. H. Curtis which
had been continued for three weeks,
was thrown out because of a faulty
warrant.
Mr. Curtis, elderly WPA laborer,
together with Lee Turnage his step
son, and Kermit Lane, was arrested
one Sunday night some weeks ago,
following a search of his house where
a quantity of bootleg liquor was
found, half of which Curtis claimed,
was charged with possessing liquor
for the purpose of sale, with manu
facturing and transporting.
Kermit Lane, who was tried three
weeks ago, was given a suspended
sentence upon conviction of manu
facturing liquor, of possession and
transporting, after the still which
Lee Turnage led officers to in the
woods, and which Turnage testified
was owned and operated by Lane
was destroyed.
When the case came up for trial
against Curtis on Tuesday, the de
fendant, being represented by- C. R
Holmes, it developed that the search
warrant, which the officers used when
search was made for the liquor was
imDroperlv drawn. It was the evi
dence of the liquor in the house
which was the basis for the illegal
possession charge, the State indicat
ing that there was no evidence to
support the charge of manufacture
or transporting.
"I am throwing out this case
against you, Mr. Curtis", said Judge
Walter H. Oakey, Jr., but I want you
to understand that the Court realizes
that Lee Turnage is not responsible
but believes that you knew what Lee
was doing when he went out with
Kermit Lane." Mr. Curtis at this
point protested that he did not know,
' that he thought they were fishing,
I "Well," said Judge Oakey, I believe
j you knew. The law just slipped up
' when it got the warrant for you and
didn't get the right warrant, and on
that technicality you got out, but you
came pretty close to trouble and I
advise you to stay clear of anybody
- who is dealing in liquor in the fut
i ure."
I Judge Oakey also stated that the
possession of liquor on which the tax
has not been paid is now illegal, no
matter where the liquor comes from.
I Lee Turnage was given a year on
I the roads, the sentence being sus
pended upon good behavior for one
i year, when convicted of the charge
, of manufacturing liquor. Turnage
admitted that he kept the fires and
carried the water for Kermit Lane
i in the operation of his still, for
I which services Lane promised to pay
him $2J0 per week.
Miles Henry Evans pleaded guilty to
the charge of reckless driving, the
case being dismissed upon payment
j of the costs.
Cleese Felton, colored, was found
guilty of assault and taxed with the
court costs.
George Elliott, colored, convicted
of the charge of assault, was given
30 days on the roads, and a former
suspended sentence of 0 days was
ordered into effect, the sentences to
run concurrently.
