This JUDGMENTS What is a judgment? A judgment Is a decision given by a court of justice as the result of proceedings which have been instituted therein. A judgment Is ordinarily for money damages. For example, If another person negligently injuries your automobile, you may bring a civil action against him and seek to recover a judgment for the amount of the actual damages to your car. If a person owes you money for any kind of contractual obligation, the first legal step you take against him is the obtaining of a judgment i .. '.'.. Does a judgment become a lien on the property of the judgment debtor? A judgment properly docketed in the office of the clerk of the superior court becomes a lien upon all the real property of the judgment debtor located in that county. The land in the county is in the nature of a security for the amount of the judgment A properly docketed judgment is very much like a mortgage insomuch as a sub sequent purchaser of the land acquires the land subject to the lien of the judgment. Although the judgment debtor may sell and further en cumbrance the property with a mortgage, the purchaser or mortgagee obtains only such value as remains after the lien of the judgment has been satisfied. Priority of liens is generally deter mined according to the time"" they' attach to the property, It may be that you have obtained a judgment against a property owner whose real estate is already en cumbranced by liens far in excess of its present value. A judgment confers no lien upon the debtor's personal property. Although .the judgmen can he satistiea oy means of an execution sale of either real or personal property, the judgment itself s a lien only upon the debtor's Is The Law real estate. Personal properly is not bound by a judgment until actually levied upon by the sheriff. . For example, Jones obtains and records a judgment against Smith. Smith has both real and personal property In the par ticular county at the time of the recordation of the judgment. Shortly thereafter Smith sells all his real and personal property to Taylor and moves to California. Taylor acquires the personaf property free and clear of the judgment Hen, but not the real property. Jones may have the real property, which Taylor has purchased, sold to satisfy the judgment which he has obtained against Smith.
