Friday. July 30.1940 of the budget year,, the head of each office, department or agency shall submit to the city manager, when required by him, a work program for the year, which program shall show the requested allotments ol the appropriations for such office, department or agency, by monthly periods, for the'entire budget year. The city manager shall review the requested allotments in the light ol the work progfam of the office, department or agency concerned, and may revise, alter or change such allotments before approving the same. The aggregate of such allotments shall not exceed the total s- 'roprlation available to' said office, department or agency for t*"? budget year. SECTION 65: The city manager shall file a copy of the allotments with the director of finance, who "* shal authorize all expenditures for the offices, departments and agencies to be made from the appropriations on the basis of approved allotments and not otherwise. An approved allotment may be revised dur* In" the budget year in the same manner as the original allotnrtent was made. If, at an" time during the budget- ve? the city manager shall ascertain that the available income, ' plus balances, for 'he year will be less than the total a-iropriations, he shall reconsider the work programs and allotments of the several offices, departments and agencies and revise the allotments so as to forestall the rnakin" of ex~"nditures in excess of the said income. - SECTION 66: The city manager may - .; * time transfer anv unen/?nmhornH o rMtrnnri o f 5r?n holanna. nr portion* thereof between general classifications of "xpendiiures within an office, department or agency. At the request of the city manager and within the last, three months of the budget year, the council mav by resolution transfer any unencumbered a"->ropriadion balance or^ortion thereof from one office,.department or agencv to another. No transfer shall be made from the anpro^riatiins required by subsections (a), (b), (c), (d), (e), (f), (g), (h), and li) of section 54 of this charter. SECTTON 67: No officer, department, or agency shall, during any budget year, expend or contract to expend any money or incur any liability. or enter into any contract which by. its terms involves the expenditures of money, for any purpose, in excess of the amounts appropriated for that general classification of enpenditure pursuant to this charter. Any contract, verbal or written, made in violation of this charter shall be null and void. Any officer or employee of the city who shall violate this section shall be guilty of a misdemeanor and, upon conviction thereof, shall cease to hold . his office or employment. Nothing in this section contained, however, shall prevent the making of contracts or the spending of money for capital improvements to be financed in whole or in part by the issuance of bonds ,uor the making of contracts of lease or for services for a period exceeding the budget year in which such contract is made, when such contract Is permitted by law. SECTION 68: All appropriations shall lapse at the end of the budget year to the extent that they shall not have been expended or lawful iy encumoerea. SECTION 69j A\ fees received by any officer or employee shall belong to the city government and shall be paid daily to the departhient of finance. . '! . SECTION 70: There shall be established in the department of finance a division of purch'ases, the head of which shall be the city purchasing agent. This purchasing agent shall constitute either the director oi finance or the city manager. The purchasing agent, pursuant to rules and regulations established by ordinance, shall contract for, purchase, store and distribute all supplies, materfals and equipment required by any office, department or agency of the city government. The purchasing agent shall have power and shall be required to: 1. Establish and enforce specifications with respect to supplies, material, and equipment required by the city government: 2. Inspect or supervise the inspection of all deliveries of supplies, materials, and equipment, and determine their quality, quantity and conformance with specifications; 3. Have charge of such general storerooms and warehouses as the council may provide by ordinance; 4. Transfer to or between offices, departments or agencies, or sell surplus, obsolete, or unused supplies, material and equipment. SECTION 71: Before the city purchasing agent makes any purchase of or contract for supplies, materials or equipollent, he Shall give ample opportunity for competitive bidding, under such rules and regulations, and with such exceptions, as the /lAiinnll mou rtrocnplho hu nrrfinflnOP' WU11VII ?"?J VM?.? W*. MJ W> I, provided, however, that the council shall not except individual contracts, purchases or sales from the requirement of competitive bidding. Nor shall the council prescribe by ordinance any rule contrary to the general law of the state of North Carolina governing municipal corporations. SECTION 72: Any city improvement costing more than $1,000.00 shall be executed by contract except where such improvement is authorized by the council to be executed directly by a city department in conformity with detailed plans, specifications and estimates. All such contracts for more than $1,000.00 shall be awardto the lowest responsi? ble bidder after such public notice and competition as may be prescribed by ordinance, provided the city manager shall have the power to reject all bids and advertise again. Alterations in any contract may be made when authorized by the council upon the written recommendation of the city manager, provided however, the direction given in this section shall not go beyond the general law as Is prescribed for the handling of contracts with respect to municipal corporations in the - state of North Carolina. SECTION 73: All purchases made and contracts executed by the purchasing agern shall be -pursuant to i a written requisition from the head i of the office, department or agency whose appropriation will be charged, and no contract or orders shall be issued to any vendor unless and until the director of finance certi fies that there is to the credit of such office, department or agency a sufficient unencumbered appropriation balance to pay for the supplier, materials, equipment or contractual services for which the contract or order is to be issue. SECTION 74: No contract shall be executed for the acquisition of any property or the construction of any improvement or betterment to be ! financed by the issuance of bonds until the ordinance authorizing the issuance of such bonds shall have taken effect and any contract executed before such day shall be unenforceable in any court of law. SECTION 75: Emergency appro, priations and borrowing to meet emergency appropriation or borrowing in anticipation ,of property taxes or borrowing in anticipation of other revenues shall be governed by the constitution and the general laws of North Carolina applicable to municipal corporations. ARTICLE 7 i SECTION 76: There shall be a City Planning Board or Commission which shall consist of five members who shall be appointed by the Council, none of whom shall hold anyother public office or position in the city. The city manager and mayor shall . serve as ex-offlcio members of the Commission. SECTION 79: The council may by resolution order a special election at any time, for the election of a new council by the qualified electors of the city. The term "qualified elector" as used in this charier shall mean a citizen having the qualifications required by law to vote in the city who is at the time regeistered to vote or, if no latejr complete registration is in effect at the time, was registered to vote in the city at the last preceding general election. Any special election of the council shall ' be held as nearly as practicable ae- |. cording to the provisions for a reg- ' ular election. The purpose of this section is to provide for the election of a member to the council in case of a vacancy. SECTION 80: The council -shall make such regulations it considers needful or desirable, not inconsis tent with this charter and the general election laws of North Carolina for the conduct of municipal'elections, for the prevention of fraud in such elections, and for the recount of ballots in'the case-of'doubt or , fraud. Public improvements for , which legislative steps have been taken under laws or charter provisions existing at the time this charter takes effect may be carried to completion and as nearly as practi cal in accordance with the provisions of such existing laws and charter provisions. SECTION-: 97 No action or proceeding, civil or criminal, pending , at the time when this charter shall take effect, brought by or against the city or any office, department or agency or officer thereof, shall be affected or abated by the adoption of this charter or by anything therein contained; but all such actions; i1 or proceedings may . be continued notwithstanding the functions, powers and duties of any office, de- | partment or agency or officer party i f thereto may be or under this charter j be assigned or transferred to ano-t ther office, department or agency or officer, but in that event the same may be prosecuted or defended by the head of the office, department or agency to which such functions po- | wers and duties have been assigned or transferred by or under this chartef. SECTION 98: Amendment and repeal of charter. This charter shall be amended or repealed as provided under Article *3 of Subchapter II, Municipal Corporation Act of 1917 same being sections 160-353 to and i including rtec+ion 160-363 of the General Statutes of North Carolina, 1943, including any and all amendments thereto. i SECTION 99: This charter when adopted by the voters of the City of Kings Mountain, shall be known j i ami may be cited as the "CouncilManager-Charter of the City . of Kings Mountain." SECTION 103: That the city couti ;cil shall have no right to appropriate any funds from any source vvhmsover except for necessary expenses as provided for under the Con stitution and Statutory Law of the State, governing Municipal Corporalions. SECTION 104: That in addition to the- powers given to the City Council, and as hereinbefore enumerated, they shall have the power under I this charter to fix salaries of all Of ficers of the City including the em ployment of a City Attorney, Heal th Officer, Building Inspector, and other personnel necessary to carry into effect the provisions of this charter under the general laws of the State applicable to Municipal Corporations. SECTION 105: That under and bv virtue of this Charter the City of Kings Mountain shall have all fran chises, property and rights in and to property which it now has under its present Charter, and shall"be liable and answerable under all con tracts, obligations and liabilities, including notes, bonds and other indebtedness, now existing: hereby validating, ratifying and confirming all contracts and obligations of the City made prior to the ratification ' of this Charter. SECTION 2: The municipal government provided by this Charter shall be known as the "CouncilMayor-Government." Pursuant to Its provisions and subject only the limitations imposed by the ?State Constitution and by this Charter, ail powers of the City shall be vested in an elective council, here inafter referred to as "the council," which shall enact local legislation, adopt budgets, determine policies, under and by the advice of the Mayor, who shall execute the laws and administer the government of the City.
