INHERITANCE OF
PROPERTY
A husband executed a will lea
ving all of his property to his
wife. Subsequently he told his
wife he wanted to make a new
will leaving certain of his prop
erty to his son. She persuaded
him not to do so, promising to
execute a will herself leaving the
property to the son.
Relying upon the definite pro
mise, made in the presence of
several witnesses, he agreed to
let his will stand as written.
The wife did not keep her pro
mise. After her husband’s death,
She executed a will leaving the'
property to her sister. Who Will
get the particular property?
The wife’s sister. This was an
actual case decided toy the Su
preme Court of North Carolina
some years ago.
Upon the death of the husband,
this particular property, along
with everything else he owned,
became the absolute property of
his wife under the provisions of
his will.

Rites Conducted
Funeral rites for John La than
Foster, 76, of route 3, were held
Wednesday at 3 p. m. from Pat
terson Grove Baptist dhurch, of
which he was a memtoer.
Mr. Foster died Tuesday morn
ing at 4:45 a. m. at his home fol
lowing an illness of several mon
this. He was a retired farmer. His
wife, the former Ida Jane San
ders, died 10 years ago.
Surviving Mr. Foster are two
sons, Dan Foster of Gastonia
and Howard Foster of Kings
Mountain; three daughters, Miss
Ellen Foster, Mrs. Junior Coe,
and Mrs. Gettys Seism, all of
Kings Mountain; 11 grandchild
ren, and five great-grandchildren.
The final rites were conducted
toy Rev. Fred Hicks. Interment
was in the Hullender cemetery.
