) Vi ^*99 4 i-y-i ■ KINGS MOUNTAIN HERALD. KINGS MOUNTAIN, N. CJ This Is The Law LAND REGISTRATION Allen bought a farm from Thompson in 1964 for $20,000. Thompson executed and deliver ed to Allen at the timb a deed to the property. The dteed was never registered in the court house. Baker knew at the time of his purchase that Allen had already bought the farm and had receiv ed a deed to it. V^o is the own er of the farm? Baker, having paid a valuable consideration for the farm, is thfe legal owner. He was the first to properly register his deed in the office of the Register of Dieeds of the county in which the land was located. though the second purchaser has full knowledge of the prior con veyance he will prevail if hb is the first to register his deed. Blood Donors Honored Allen has no causfe of action against Baker. His re.Tiedy is to sue Thompson for breach of con tract. Let us hope that Thomp son still owns unencumbered property from which the judg ment'might be satisfied. Mi-s. Charles Mauney was elected secretary of the Cleve land County Rt^ Cross Chapter and Fain Hainbright of Grover was elected second vice-president during the annual dinner meet ing here Friday night at Kings Mountain liigh school. Other Kings Mountain area citizens named to the board of directors were Rev. George Juli- was docket an, Bob F. Maner, L. G. Brower, and Dr. Frank Sinoox. Thursday, June 9, 1966 Dick Buse of Shelby was nam ed chapter chain.Tian for the coming year and Bill Campbell of, Shelby was named first vice- president. Horace Carter of Shel by will serve as treasurer and ' L. C. Brewer of Kings Mountain will serve as assistant treasurer. The law requires all convey ances of land to be recorded. Un-1 der the recording statutes the i owner of real property retains a; power to defeat his earlier con- j veyance, if not recorded, by a subsequent conveyance to a sec ond purchaser. This encourages prompt registration. Tiffany conveys land to Pow ell on a Monday morning, but Powell dobs not register his deed until the following day. On Mon day afternoon Simes obtains and dockets a judgment against Tif fany in the county w’here the land is located. May Simbs two years later have the land now owned by Powell sold to satisfy his judgment against Tiffany? In North Carolina, bven Yes. Powell brred in not hav ing his deed registered pra.mptly upon delivery to-4iim. Tiffany was the rec’orded owmer of thb land at the time the judgment White conveyed land to Black thrbe years ago. The deed to the land has never been registered. As between Whitb and Black, who is the owner of the land? Black. A deed is valijl as bc- twebn the parties to the transac tion without registration. Black's ownership of the land will be protected against the claims of all persons other than erbditors of White who docket judgments and purchasers for valuable consideration from ,White who register their deeds. Other directors are Robert Bordbrs of Waco, Tom McGraw, Robert Oabaniss, Mrs. Carolyn Freeman, .Lyndon Hobbs, Mrs. Martha London, Dr. H. S. Plas ter and Dean W'hisnant, all of Shelby. Thirty Clevelandbrs received plaques as multiple gallon don ors. The vO donors who contri buted 122 gallons of blood dur ing the past year gave >4 of all the blood collbcted during 21 visits of the Red Cross bloodmo- bile. Among the top donors were R<ay W. Cline and James L. Ben- nbtt, both of Kings Mountain, six gallon donors; John A. Cheshire, Jr. and Grady Howard, both of Kings Mountain, fi%'e gallon don ors; Charles E. Ballard, Robert Lee Wilson, Bob F. Maner, and Henman T. Cash and Howard Stokes Wright, all of Kings Mountain, four gallon donors; and Robert P. Ware, Azri J. Jamerson, Gaither W. Ledbetter, Kenneth Metcalf, Luther Cave- ny, and Sam R. Suber, Jr., all of Kings Mountain, three gallon donors. A mimeographed program in booklet form outlined the Red Cros? activities during the year and the opening page was a me morial to Mrs. Ruth Davis Gam ble, executive secretary of the Kings Mountain chapter from 1932-64. The "In .Memoriai.m” read: “Her selfless devotion and dedication to her work earned for Mrs. Gamble the respbcf and admiration of all who knew her.” Albert Eugene Holcomb, Amer ican Red Cross field director from Fort Bragg, made the key note address in which he cited the serviefes of Red Cross “a- round the clock, around the world.” Rev. COMMON SENSE vs. NONSENSE me of a uries of classic quotations dealing tuilh subjects of interest to you’. ~J» "It’s unwise to pay too mucKt but it’s worse to pay too little. When you pay too much, you lose a little money— that is all. When you pay too little, you sometimes lose everything, because the thing you bought was incapable of doing the thing it was bought to do. The common law of business balance prohibits paying a little and getting a lot —it can’t be done. If you deal with the lowest bidder, it is well to add something for the risk you run, and if you do that you will have enough to pay for something better.” -Johii Ruskin (18194900) KINGS nOUMTATNl DRUG COMPANV W 11 Thu Jai Jol Jui Sa Tb
