Re-Count Is Denied

was not contacted in any of
the processes of that recount
and we were not granted the
privilege of being present ata
hearing, if in fact, a public
hearing was held as state law
requires. We only received
from the board of elections
the final verification of the
balloting. We do know that
the recount in 1983 revealed
that in two of the three issues
on the ballot there was a sw-
ing of exactly six votes’, said
Land, who added, “We sub-
mit that the results of the
past alcohol referendums in
Kings Mountain have shown
that the citizens are about
equally divided on this issue.
It is an issue with deep emo-
tional and self interest
aspects and we want
everyone to be assured that
ballots were tabulated and
exactly as tabulated.”
Land sais that on the issue
of alleged ‘illegal voters, the
large number of citizens
registered just prior to this
referendum by special
registrars who went from
house to house greatly in-
creased in their opinion the
margin of error in registering
non qualified citizens.”
Jim Carroll, a member of
the elections board, said if
the present board allowed a
recount on the basis of ‘no ir-
regularities” it would be set-
ting a precedent.” There
have to be facts presented to
us that show violations of the -
law. There were no im-
proprieties and I can’t vote
for a recount. If you come to
us with violations of the law I
will vote for a recount.” Car-
roll said that the recount of
three years ago was a strict
violation and an illegal elec-
tion which was not verified.
“I don’t know why it was not
recalled”, he said.
Mrs. J.C. Marable and
Chairman Cook agreed with
Mr. Carroll there was no
evidence of voter ir-
regularities.
Mrs. Cook noted that
‘‘fresh counters’’ were
brought in to help with the
counting and that ballots
were counted as many as
three times with all No’s on
one table, all ‘yes’ on the
other, and all split votes on
the other. The same pro-
cedure was followed at both
East and West precincts.
Mrs. Cook says the law
does not provide for ‘fresh
counters” at an election and
citied examples when she
herself worked at the polls for
20 years and as late as 5 a.m.

votes in city elections.
Mrs. Cook says she has
voter printouts from the
county showing list of voters
at both KM precincts and she
also has a copy of the ABC
petition : bearing the
signatures of citizens asking
for the election. She said that
numerous peo le had called
to say they had not signed the
petition.”” This board has no
responsibility in registering
voters. All we can do is look
at printouts supplied us by
the county.

out of politics and impartial-
ly. The City of Kings Moun-
tain, but not necessarily the
ABC Commission, will be
allowed to review those per-
.mit applications and they
have an opportunity to turn
down those people they think
may not be qualified.
However, those people can
file for an appeal to Raleigh
and even though the city ob-
jects to a person being issued
a permit there have been in-
stances that the state has:
overruled and issued per-
