- Page 10A-KINGS MOUNTAIN HERALD-Wednesday, January 6, 1988 Bollinger Suing City And Former Policeman Kings Mountain resident Phillip Bollinger is suing the City of Kings Mountain and former policeman Don Johnson for assault and bat- bors abuse of process, malicious prosecution and false imprisonment and ask- ing a jury trial to award judg- ment in excess of $10,000 from the defendants, jointly and severally. ; The civil suit was filed by Frank Patton Cooke and . Malcolm B. McSpadden, at- torneys for Bollinger, in Gaston County Superior Court. The defendants receiv- ed the civil summons on Dec. 16. In the suit, Bollinger alleges that he was “wrongfully and illegally ar- rested by Johnson and falsely accused of running a red light, shoved against the city police car and handcuffed and transported to Cleveland County Jail and held in the magistrate’s office for a lengthly period of time.” He accuses Johnson of ‘‘violently assaulting the plaintiff’s father, Stretch Bollinger,” who was off duty but at the time also employed by the ci- ty of Kings Mountain as animal control officer. Boll- inger said he was placed in jail for seven hours after be- ing ‘‘wrongfully and illegally falsely accused and that Johnson issued warrants against the plait for runn- ing a red light, assaulting and striking a law officer and resisting, delaying and obstructing a law officer.” DONNA CANOVA Bollinger seeks $750 and also future legal expenses to ex- punge the record of his arrest and says he suffered “severe mental and emotional distress and injury to his reputation due to the wrongful arrest.” Bollinger alleges that Johnson ‘willfully used the court process with bad intent and with an ulterior purpose designed to coerce and harass the plaintiff and to retaliate against the plaintiff for a personal grudge he had against the plaintiff and the plaintiff’s family.” Bollinger alleges that “Johnson was not engaged in the performance of a govern- mental function but was engaged in retaliation involv- ing a personal grudge.” In the first claim for relief, the plaintiff seeks $10,000 from Johnson and the City of Kings Mountain for assault and bat- tery. He alleges that his left side stomach was bruised causing him pain and suffer- ing. In the second claim for relief, the plaintiff seeks $750 in attorney fees, injury to reputation, mental suffering and emotional distress in ex- cess of $10,000. In the third claim for relief, Bollinger seeks an amount in excess of $10,000 and $750 in attorney fees for malicious prosecution and in the fourth claim for relief the plaintiff seeks $750 and an amount in excess of $10,000 due to alleg- ed false imprisonment. Volunteers with the Kings Mountain Hospital served a total of 1233 hours at the hospital last year and those serving more than 80 hours were recognized with flowers. Jeannette Mann was the top volunteer followed by Ann Reep, Jackie Hollifield and Helen Yates. Forty-one “pink ladies” and Junior Auxiliary members received recognition certificates for hours worked. ‘Pink Ladies’’ deliver flowers and mail to patients and perform other duties to brighten their days. Assistance was given in the Emergency and waiting rooms, Life Line, Pharmacy, in the materials management department, at the reception desk and in running errands for the nursing units. A project new this year will be to assist with the new Mothers Clinic with personal . attention to both the mothers and baby needs. The Auxiliary was first organized in 1946 and recent- ly was reorganized.
