at her home, were conducted

She was the widow of
Adolphus Byers and the
daughter of the late Jimmy
and Janie Mason Adams.
Surviving are five

Mountain and June Adams of
Shelby; two sisters, Corrie
Mintz of York, S.C. and Ola
Mae Tate of Kings Mountain;
and five grandchildren.

Mr. Jones was a retired
farmer and son of the late

Mrs. Dover was a retired
textile employee and widow

A native of Jackson County,
she was the daughter of the
late John and mattie Mathis
Holcombe. She was a
member of Way At the Cross
Freewill Baptist Church.
Surviving are four sons,

Funeral Home Chapel in

following in Kings
Mountain’s Mountain Rest
Cemetery.
Mr. Smith was a native of
Lincoln County, son of the
late Guy and Rose Self Smith.
He served as a sergeant in
the Army during World War
II and was a POW in Ger-
many.
Surviving are his wife, Bar-
bara Fuller Smith; two sons,
Kenneth and William Smith
of Kings Mountain; two
daughters, Rita Bridgeman
of Travelers Rest, S.C. and
Kim McKinney of Dallas; a
sister, Gladys Burton of
Kings Mountain; and five
grandchildren.

Clemmie C. Summitt, 83, of
Route 4, Chapman Lake
Road, died Jan. 31 at Kings
Mountain Hospital.
A native of Cleveland Coun-
ty, he was a retired farmer
and textile employee and a
member of Mountain View
Baptist Church.
He was the son of the late
William Pinkney and
Margaret Henson Summitt.
Surviving are his wife,
Mary Causby Summitt; six
sons, L.G. and J.L. Summitt
of Kings Mountain, W.C.
Summitt of Kershaw, S.C.,
Buford Summitt of Grover,
Richard Whitstine of Kings
Mountain and Bruce
Greene of Charlotte; a
daughter, Wilhelmina

chell Pruitt officiated. Burial
was in Wallace Grove Baptist
Church cemetery in Shelby.

Huffstickler Smith, 93, who
died Friday at Brian Center
in Gastonia, were held Sun-
day at 3 p.m. from Mountain
Rest Cemetery by Rev.
Leonard Bumgardner.
A Cleveland County native,
she was the daughter of the
late Albert and Martha Huff-
stickler. Her husband was the
late John Wishum Smith. She
was a member of Fellowship
Christian Center in Dallas.
Surviving are two
daughters, Grace Smith
Harney of Gastonia and
Pauline Smith Queen of
Garner, seven grandchildren
and 19 great-grandchildren.

Road, who died Friday in the
Kings Mountain Hospital,

Church of which he was a
member.

was in the church cemetery.
Mr. Ledford was a
Cleveland county native,
retired textile worker, and
son of the late Jesse and
Daisy Padget Ledford. His
first wife was the late Oatsie
McDaniel Ledford.
He was a World War II
veteran.
He is survived by his wife,
Mildred McGinnis Ledford; a
son, Ricky Ledford of
Grover; a daughter, Terry
Ledford of Kings Mountain; a
stepson, Robbie Montgomery
of Kings Mountain; two step-
daughters, Linda Yarbro of
Kings Mountain and Anita
Champion of Cherryville; a
brother, Plato Ledford of

‘Order To Compel’ Field
Former Mountain Rest
Superintendent Ken Jenkins,
through Shelby attorney Bill
Lamb, filed motions in
Cleveland County Superior
Court Tuesday for ‘Order to
compel” WBTV television
reporter Chris Clackum and
Kings Mountain Herald
reporter Lib Stewart to
disclose under
court” identity of confiden-
tial sources in a $3.8 million
libel and slander suit against
the City of Kings Mountain.
Both WBTV of Charlotte
and The Kings Mountain
Herald have relied upon First
Amendment protection,
refusing to name or identify
confidential informants in
news stories and television
reports dealing with the in-
vestigation and operation of
Mountain Rest Cemetery by
then-superintendent Ken
Jenkins who was fired by the
City on Aug. 16, 1985.
Lamb also filed a motion
for extension of time within
which to file notice of appeal

and motion for order to com-
pel discovery and for imposi-
tion of sanctions.
Four of seven claims
against city officials by
former Cemetery Supt.
Jenkins in a $3.8 million
lawsuit were dismissed Feb.
1 by Superior Court Judge
Robert Lewis.
Judge Lewis did not rule on
motions to dismiss three
claims of libel against the ci-
ty but gave Attorney Lamb
until Feb. 29 to produce
evidence that one or more of
the city officials named in the
suit were responsible for
allowing the publication of a
confidential report regarding
Jenkins tenure at the city-
owned cemetery.
Judge Lewis dismissed
claims of invasion of privacy,
denial of due process, breach
of contract and intentional in-
fliction of emotional distress
against Jenkins.
Jenkins filed the suit
against the city in 1986 nam-
ing former Mayor John
Henry Moss, Commissioner
Humes Houston and former
Commissioners Irvin M.
Allen, Jr., James Dickey,
Curtis Gaffney and Corbet
Nicholson. In affadavits
presented to the courts the
defendants contend they did
not keep their copies of the
confidential report and didn’t
give them to anyone. In his
deposition, Commissioner
Norman King, the only one of
the six to vote not to fire
Jenkins and the only commis-
sioner not named in the suit,
said he kept his copy of the
report but turned it over to
Lamb shortly after Jenkins
was fired.
Judge Lewis said he would
rule on all the libel claims
and Jenkins request to
recover punitive damages
against the city during the
Feb. 29 term of Cleveland
County Superior Court.
