Kings Mountain had asked for an agreement of eight years. Kings Mountain had also asked that the main meters be moved and the new agreement calls for maintaining a master meter at a connector point where Kings Mountain’s sewage shall enter the system for the purpose of measuring sewage delivered to Gastonia for treatment and disposal. The meter will be installed at the confluence of McGill Creek and Crowders Creek and the meter shall be and remain the property of Gastonia. The agreement also spells out that in the event ¢ Kings Mountain’s wastewater discharge needs ex- PREFER EET ERNE : ceed 2.28 million gallons per day to negotiate with Gastonia for the use of any unused plant capacity. Gastonia will construct, maintain and operate the facility along with the monitoring and transpor- ting facilities located in the Crowders Creek ¢ drainage basin of six million gallons per day in ae- : cordance with applicable state and federal Ee statutes and regulations. Under the agreement Kings Mountain agrees: To own, construct, operate and maintain ¢ facilities necessary to collect and transport : sewage within its service area to points of connec- ¢ tion with the system and to adopt similar regula- ¢ tions regarding the discharge of wastewater into i its system to the pretreatment ordinance adopted ¢ by Gastonia and presently in effect and as may be : hereafter amended and as approved by the ap- i plicable state and federal agencies. The ap- : propriate regulatory agencies of the state of North . Carolina must approve any such ordinance or amendment thereto enacted by Kings Mountain. Kings Mountain shall be deemed a customer of Gastonia and shall be subject to all provisions of Gastonia’s pretreatment ordinance. Kings Mountain agrees that the entire flow generated by the McGill Creek Drainage Basin ¢ shall be discharged into the system. Kings Mountain agrees to pay Gastonia not later than the 20th of each month an amount equal to Kings Mountain’s total flow discharged to and treated by the system multiplied by the rate charged to industrial customers inside the city limits of Gastonia as it may be amended from time to time. In the event Kings Mountain’s peak flow daily flows exceed those set out for five consecutive days or if the average daily flows for any monthly billing period exceeds the 2.28 million gallons per day, Kings Mountain shall pay to Gastonia for operation and maintenance of the system a sur- charge of 150 percent of the normal rate times the excess flows. Kings Mountain shall have an average minimum daily flow to the plant of 1.9 million gallons per day. If the average daily flow for any billing period drops below 1.9 million gallons per day, Kings Mountain shall allow Gastonia to audit its records to ensure that the flow from McGill Creek Drainage Basin is being discharged into the system. Kings Mountain agrees to assign to Gastonia all state or federal grants received by Kings Moun- tain due to development of the project. Gastonia shall use such funds in the development of the pro- ject. Kings Mountain agrees to dedicate all assessments and rights-of-way over property own- ed by Kings Mountain necessary for maintenance and construction of the system. j Kings Mountain will not annex East of the line indicated on a map attached to the contract and Gastonia agrees not to annex West of said line for a period of six years from the date of execution of the agreement. In the event Gastonia decides to expand the system, Kings Mountain will not be obligated to pay any portion of cost of such expansion unless it has agreed in writing prior to construction to con- tribute such costs. The term of the agreement shall be 30 years from the date of execution or the useful life of the plant as determined by Gastonia, whichever is greater. The contrast stipulates that the sewer line located between the McGill Creek Treatment Plant and the Kings Mountain sewer meter shall be and remain the property of Gaston County until such area is annexed. Upon annexation, the line shall be conveyed at no cost to the municipality which annexes the area in which the line is located. Kings Mountain shall maintain the line until such time as the line is annexed. If the loca- tion of the meter is changed due to annexation, the party requesting the relocation shall bear the en- tire cost thereof. Gaston County’s share of the project-32 percent -won’t change. It will remain between $3.8 to $4.5 million. Bessemer City’s share, $800,000, will also remain unchanged.
