Human Habitation - Demolish Or
Remove)
THIS HEARING having been con-
ducted by the undersigned on the 17th
day of December, 1992; pursuant to a
Complaint being filed as to the fitness
of a dwelling for human habitation
within the City of Kings Mountain,
North Carolina; and after hearing evi-
dence and testimony, it is found:
FINDINGS OF FACT:
1. That the subject property does
bear the address of 103 Urban Drive,
Kings Mountain, Cleveland County,
North Carolina.
2. That owners of such property are:
J.C. and Lucy Dellinger, Ruby
Bowman, R.A. Dellinger, and others
(whereabouts unknown) who have all
been served with a copy of the
Complaint filed herein, and Notice of
Hearing, issued. Also, Notice of
Hearing has been published in the local
newspaper twice.
3. That those present at such hearing
were: Chris Rossi, Director of
Inspections; Jeff Putnam, Building
Inspector; Dottie Elkins, Secretary.
4. That no testimony was offered for
or against the Complaint.
5. That it is found that the following
conditions of unfitness do exist at the
dwelling:
Supporting member or members
which show thirty-three (33%) percent
or more of damage or deterioration or
nonsupporting enclosing or outside
‘walls or covering which show. fifty
(50%) percent or more damage or dete-
rioration; or,
loaded, or which have insufficient
strength to be reasonably safe for the
purposes used; or,
Dilapidation, decay, insanitation or
disrepair, which is likely to cause sick-
ness or disease, or to work injury to the
health, safety or welfare of the occu-
pants or other people of the County and
City; or, -
Defects therein increasing the haz-
ards of fire, accident or other calamities
such as lack of adequate ventilation,
light, heating or sanitary facilities as
endanger the health, morals, safety or
general welfare of the occupants or
other residents of the County and City;
or,
Such relationship to adjoining build-
ings or dwellings that light or air is in-
adequate or that a fire hazard exists; or,
The dwelling is in a severe state of
disrepair and constitutes a hazard to the
safety of the general public.
6. That based upon the existence of
the above conditions existing, such
dwelling is found to be unfit for human
habitation, and that costs of repairs or
improvements will exceed fifty (50%)
percent of the value of the dwelling.
IT IS THEREFORE, ORDERED:
1. That on or before the 22nd day of
January, 1993, the owners of the
dwelling, shall remove or demolish the
dwelling.
2. Failure to remove or demolish the
dwelling on or before the above date,
will result in a possible ordinance be-
ing passed by the City Council for the
City of Kings Mountain, North
Carolina to cause the dwelling to be re-
moved or demolished.
