Thursday was Lybrand's sec- ond appearance at the Planning Board in the past year to talk re- ~zoning of the property. However, last year he withdrew his request. Planning Board Secretary Gene White said that under pre- sent zoning of the property the developer could put up a conve- nience store. White said that he is forward- ing information to Board Chairman M. C. Pruette, Lou Ballew, Roger Goforth, David Faunce and Joe Smith after the question was raised about re- zoning the property for condi- tional use which Lybrand has not requested. White said the rezoning item is on the agenda for the November 29 City Council meeting at City Hall. The coun- cil has the option of approving or tabling the project or agree- ing with the P&Z board and tabling it for further study. Engineer Al Moretz illustrat- ed with maps the location and the proposed structures which he described as luxury apart- ments. Jennings presented a financial analysis which he said indicated that the rezoning would be a "detriment to the adjacent neighborhood." In other actions, the board: Denied the request from Brenda Robinson Belt to rezone property at 205 King Street from N-B to G-B for a used car lot. Board member Lou Ballew questioned if the rezoning would constitute flagrant spot zoning. Smith and member David Faunce expressed oppo- sition. Members Roger Goforth and Chairman M. C. Pruette al- so voted against the proposal. The board voted to rezone property of Hubert Toney at the corner of Waco Road and Gantt Street from L-I to N-B over the objections of Tommy Barnette and Paul Gaffney who said they represented adjoining property owners in opposing the rezon- ing. Pruette abstained. Toney said he wanted to lease the property for a barber shop. He told citizens that his intent was not to "damage the area." Responding to questions, White said the property could only be leased for such opera- tions as a barber shop. The zon- ing designation would have to be GB, for instance, to accom- modate a lessee who wanted to obtain a beer license.
