Briefs Clary votes to protect back intangibles tax Rep. Debbie CLary joined with her colleagues in the North Carolina House this week to pass a bill to protect taxpayers from paying back tax- es on intangible property. Following a recent North Carolina Supreme Court ruling, the state Revenue Department has planned to collect addition- al intangibles taxes from 1990 to 1994. The bill passed by the House this week would prohib- it such collections. "This is an important bill to protect North Carolina taxpay- ers from unfair taxes. Rather than ordering tax refunds, the Court ruled the state should in- stead collect back taxes. This simply defies common sense and the House has made a stand against such unjust taxa- tion," said Clary. House Republicans led the fight to repeal the intangibles tax in 1995. After it was re- pealed, the United States Supreme Court ruled the tax ex- emption for North Carolina stock was unconstitutional be- cause it discriminated against out-of-state companies. However, the court ruling did not order refunds and left open the option of assessing intangi- bles taxes on those who did not pay due to deductions given to North Carolina companies. Such a tax assessment would re- sult in $375 million in addition- al taxes placed on North Carolina taxpayers. The House bill passed this week would stop these additional taxes from being assessed. aR Additionally, if the bill passes the Senate and is signed by the governor it would make the state liable for refunds to those taxpayers holding out-of-state companies stock who protested the tax between 1990 and 1994. "House Republicans have proven once again we are com- mitted to protecting the taxpay- ers of this state. This bill saves taxpayers over $300 million and will start the process of refund- ing these taxes. This is exactly the kind of fiscally responsible action the voters sent me to Raleigh to support,” Clary said. To register, call 484-4040. : Registration under way for KM kindergartners Children who will be five years old on or before October 16, 1997 should register for kindergarten in their respective school districts. If parents do not know which school their child will attend, they should call the Kings Mountain District Office at 734-5637. Applications and Kindergarten Health Assessment Reports are avail- able at all elementary schools. The application should be com- pleted and returned to the school as soon as possible. The Kindergarten Health Assessment Report is to be completed by the child's physi- cian or the health department and is due on or before September 8. Orientation day for incoming kindergarten children and their parents is May 9 at all elemen- tary schools. Parents are to take their child's official birth certifi- cate and social security number. Children cannot be enrolled without the official birth certifi- cate. On orientation day, parents will take their child to school at 8:30 a.m. and remain for an in- formative session’ with the school principal which will last approximately one hour. The children will go to classes and enjoy a typical kindergarten day, ending with lunch as guests of the school system. County rescinds moratorium County commissioners Tuesday night rescinded an ex- isting moratorium on develop- ment of lots of less than three acres in the Waco/Fallston area and set public hearing for input on a new 90-day moratorium for April 15. The action means that be- tween now and April 15 that some development could pro- ceed. The new moratorium would prohibit development and ex- ansion of sub-division, manu- actured home parks and multi housing developments in the area northwest of Waco to the Gaston County line. It would not, however, apply to any existing developments with vested rights. Commissioner Joe Cabaniss, who made the motion, said the moratorium period would al- low the county planning board to develop recommendations for a new zoning district and re- act to the rural agricultural zon- ing classification proposed in a petition to zone more than 13,000 acres of northeastern Cleveland County. That petition and request was referred last month by the county board to the planning board for study. The Planning Board had adopted the recom- mendation at a recent meeting but some county residents have been up in arms since and a seat was hard to find at Tuesday's regular Commissioner meeting. County Attorney Julian Wray said the county erred when it did not post adequate notices and provide written notice to adjoining property owners and proper notice was not given ina county newspaper. "A moratorium will give the county breathing time to work out these technicalities which should not be done in haste," he told a standing room only crowd in the Commissioners Chambers in Shelby. Commissioner Willie McIntosh made the motion that Tuesday's scheduled public hearing on the matter be can- celed and rescheduled after the technicalities are corrected and under the direction of the coun- ty attorney. The motion passed 5-0. Commissioners Ralph Gilbert and Mary Accor were absent. Also voting were Bobby Malloy, Joe Cabaniss, Chairman Jim Crawley and Ray Thomas. McIntosh also made the mo- tion that the existing moratori- um adopted by the board at its March 18 meeting be rescinded because the legal technicalities had not been met. That motion passed 5-0. Cabaniss then made the mo- tion which outlined the new moratorium public hearing, al- so a legal requirement, accord- ing to the attorney. : —Sinee there are no restrictions on zoning in the county, devel- opers in the next two weeks would only have to meet neces- sary subdivision ordinances in place and county health regula- tions, the attorney said. Wray said the notice of the public hearing must be adver- tised for two successive weeks in a local newspaper and the first advertisement must run at least 10 days prior to the hear- ing. KM man tells police he was robbed Police are investigating the reported armed robbery of a man in his home April 1.
