The Kings Mountain Herald -Second primaries assured A federal appeals court threw out a 1994 agreement the coun- ty entered into with the NAACP that put Bobby Malloy and Mary Accor on the board as minority representatives. The appeals court ordered Judge Stanley Sporkin to work out a schedule for electing commis- sioners. He ruled that the com- mission would return to the form it had before the agree- ment, five seats, and that all would be filled with a primary Nov. 3, a second primary, if needed, on December 1 and election Jan. 12,1999. Under the ruling, the two candidates receiving the most votes in the general election would serve four year terms, the next three would receive two year terms and thereafter everyone would serve four years to return to the stagger that would have been in effect if a consent degree had never been entered into by the county and the NAACP. Kings Mountain bond rating upgraded The city's bond rating has been upgraded by Moody's Investor’ Service, New York, from Baa to Baal, City Manager Jimmy Maney announced to City Council Monday night. "This means we can borrow money if we need to but we are financially sound," said Maney, which immediately brought the suggestion from Councilman Clavon Kelly that the city float a bond issue to pay for a second water line from Moss Lake to Kings Mountain. Kelly's suggestion brought the comment from Councilman Gene White that the city needed to have the true status of the water line in use since 1974 and then make an evaluation. "This is a 25-year-old line and the interest rates are low now," said Kelly. Councilman Rick Murphrey said after the meeting that the city had other obligations now in the form of a $1 million law enforcement center and major recreational improvements. The city's bond indebtedness is $8.6 million. Bond payments of $708,000 are due March 1, 1999. Maney praised City Council for the good news of the bond rating, which was lowered from A to Baa December 1994 largely due to severe financial stress. The new rating represents medium grade security and is the highest in the medium grade category. Maney said that by sending updated financial statements, forthcoming in the audit board members receive in October, could advance the rat- ing even higher. "From an investment stand- point, bonds should be at least investment grade and we are above investment grade," he said. White said the rating hike took three years of hard work by the city manager and staff and that the council could take no credit for it.
