P&Z Board approves day care expansion BY ANDIE L. BRYMER Staff Writer The Kings Mountain Zoning and Planning Board narrowly approved a request by childcare provider Robin Smith Tuesday. Smith, owner of It Takes A Village Childcare, hopes to expand her North Piedmont Avenue home based business. Currently, she cares for six children in her home but wants to renovated the basement to accommodate up to 12 children. Clavon Kelly, representing First Wesleyan Church, spoke out against the expansion on four counts. According to Kelly, parents sometimes sound their car horns when picking their children up late at night. The day care cen- ter provides second shift care. He argued that the children would create noise when playing which could disturb the nearby parsonage. “I don’t think this is going to fit next to a parsonage,” he said. Kelly said the location was not safe for children because trucks from the city’s utili- ty plant use the street. Kelly called the request spot zoning. Board member Preston Todd made a motion to deny the request but the motion did not receive a second. “I don’t think we can have too many day cares but once we open the floodgate to businesses others are going to ask,” he said. Board member Ron Humphries made a motion to approve the request which received a second by Lou Ballew. Board member Dave Allen voted in favor of the motion creating a majority. Ballew attached a requirement to the motion calling for additional fencing. “If you don’t fence that yard, I'll be out there on you,” Ballew said. Board member Steve Marlowe said he was opposed to approval but did not second Todd's motion because at the time he still had an unanswered question. He said he would have voted against Humphries’ motion but when it received majority approval there was no opportunity. Marlowe called the vote “tough” and praised Smith's day care plan but said he was opposed because it appeared to be spot zoning and because neighbors had issues. Approval by the planning and zoning board is not legally binding. The city council must approve the request during its Feb. 23 meeting before Smith can expand her day care. Man suilty of not filing taxes RALEIGH - A Cleveland County man pleaded guilty last week to failing to file and pay North Carolina taxes. Howard B. Roberts, Jr., 54, of 111 Goforth Road, Kings Mountain, pleaded guilty in Wake County District Court to one count of willfully fail- ing to file sales tax returns and one count of willfully failing to pay sales tax to the North Carolina Department of Revenue. The charges were in connection to a Kings Mountain conven- ience store owned and oper- ated by Roberts. District Court Judge Craig Croom sentenced Roberts to 45 days in jail. Roberts was ordered to pay a $500 fine, $100 in court costs, a $200 commu- nity service fee and to per- form 25 hours of community service within six months. Roberts was further ordered to timely file and remit all future taxes. Before sentenc- . ing, Roberts paid the Department of Revenue $12,038.91 in restitution. The charges against Roberts resulted from an investigation by a field audi- tor in the Department of Revenue's Hickory Office and a special agent with the Department's Criminal Investigations Division. and Bera Dameron. Wells of Kings Mountain; daughters Sylvia St. Just and husband Michael of Kings Mountain, Toni Richmond and hus- band Jeffrey of Hickory, and Anne Marie Krauth and husband Rob of Lincolnton; sister Jane Kaiser of Bessemer City; and grand- children Jessica Richmond, Danielle St. Just, Joshua Richmond, Shelby St. Just, Erin Krauth and James Richmond. The funeral was conduct- ed by the Rev. Cyrus Frazier at.2 p.m. Monday at Grace Lutheran Church in Bessemer City. Burial was in Bethany ARP Church Cemetery in Clover, SC. Harris Funeral Home was in charge of arrangements. HAZEL GOAN SHELBY - Hazel Loveday Goan, 92, 4043 Pleasant Grove Church Road, died February 7, 2004 at Cleveland Pines Nursing Home. She was a native of Sevierville, TN. She was retired from Alcoa in Maryville, TN, and was a member of Beech Grove Baptist Church in Maryville. She is survived by her grandsons, Doug Greene and wife Angie of Lattimore and Daniel Greene and wife Cheryl of Shelby; and four great-grandchildren. A graveside service was held Wednesday at Sherwood Memorial Garden in Maryville, TN, with the Rev. Kenny Armstrong offi- ciating. Harris Funeral Home was in charge of arrangements.
