Lvt nii.ht .ibout H o'clock, Washing ton Tucker, a middle aged colored man, who lived on a cross street near the sub urbs of Brooklyn, died very suddenly of heart dire. Tucker had been to church and after returning home com plained of feeiing bi dly and in a few min utes thereafter expired Spec.al Coroner A. II. Leslie, who has been appointed to 8erYe during Coroner Hewlett's illness, was notified of the death this morning and after summoning a jury repaired to the house in which Tucker died. The verdict of the jury was "death from! nat ural causes, supposed to be heart disease." Digest of Opinions. We glean from the Baleigh News the following digest of opinions delivered re cently in the Supreme Court : By Smith, C. J. State vs. Chadbourn from New Hanover. A firm, which buys timber 1 and con verting it into lumber sells it, but which does not buy lumber nor sell timber, are not "traders" and are not subject to the license tax imposed on such by the Reve nue Act. I ! By Smith, C. J. State vs. James from New Hanover. Where the party on whose false oath a warrant of arrest in a criminal proceed ing was issued accompanied the officer andipointed out the defendant. Held he was as mueh. protected as the officer and U not indictable for assault and bat tery. The warrant being issued by com petent authority no enquiry is admissible into the circumstances under which it was issued. The defendant has a remedy by an action for malicious prosecution By Dillard J: Kerchner vs. McRae from New Hanover. .The gen eral rule that parol testimony is inadmissible to add to, j vary or contradict a written contract is re stricted to cases in which the parties express in writing the entire stipulations agreed on. Where an issue as to a parol agreement is not objected to, parol evU dence tending to prove the same can not be incompetent. It is discretionary with a judge whether he shall interrupt counsel if his remarks are improper or to correct them in his charge to the jury. It is not error to charge a jury in a civil case that they must decide according to the preponderance of the evidence. Ex ecutors are responsible in their represen tative' capacity on contracts originating in testator's lifetime, but in causes of ac tion wholly accruing after testator's death they are liable individually.
