In the case of M r. II. Kirby Smith a former student of the University of Nort h Carolina, tried at (iolds iioro. this week, the jury could not agree on a verdict and was discharg ed. The case is one of peculiar in terest. The News and Observer says that the suit was brought by Mr Kirby Smith against President Rat- t e amljMr (. .ini'ton, who was ajtrus t e, charging malicious prosecution and claiming $ lO.IKMI damage. U will be remembered that Mr. Smith was arrested the day after commence ment, nearly two years ago, charged with painting the Caldwell monu ment, in the campus w ith red paint. The plain tiff allowed an abatement as to Mr. Cameron after his death and continued it against Dr, ISatlle alone.
