NOTICE OF SALE OF LAND NORTH CAROLINA WAKE COUNTY UNDER AND BY VIRTUE of the power of sale contained in a certain deed of trust executed by Mozell Fowler, unmarried, to Foster D. Finch, Trustee for Min nie Jones Fowler, dated April 22, 1961, and recorded in Book 1453, Page 289, Wake County Registry; default having been made in the payment of the indebtedness there by secured and the said deed of trust being by the terms thereof subject to foreclosure, and the holder of the indebtedness there by secured having demanded a foreclosure thereof for the purpose of satisfying said indebtedness, the undersigned trustee will offer for sale at public auction to the highest bidder for cash, at the courthouse door in Raleigh, Wake County, North Carolina, on Mon day, December 11, 1961, at 12 o’clock, noon, the land conveyed in said deed of trust, the same lying and being in Wake Forest Township, Wake County. North Carolina, described as follows: Tract No. 1. Beginning at a point in the center of the Roles ville-Forestville paved county road, said point being the extreme Southern point of the Lucy Fow ler land and the Westernmost point of the Hardy Fowler land; thence along the dividing line be tween the Lucy Fowler land and the Hardy Fowler land N. 50° 45’ E., 2730 feet to a stake in the George Carlson line; thence with said Carlson line S. 72° 15’ E., 1020 feet to a stake in the old road; thence along said road as follows: S. 17° 30’ W„ 200 feet; S. 16° W„ 200 feet; S. 16° 15’ W„ 400 feet; S. 13° 30’ W., 200 feet; S. 12° 15’ W., 202 feet to a rock; S. 2° 10’ W„ 392 feet; S. 3° W., 215 feet to a rock, corner in the J. R. Freeman line; thence with said Freeman line N. 84° W., 2509 feet to a rock; thence S. 10° 10’ W., 192 feet to an Elm tree at or near the aforesaid Rolesville-Forest ville paved county road; thence along said road N. 40° 40’ W., 245 feet to a point in said road; thence N. 30° W., 100 feet to the point of beginning, containing 78.5 acres, according to a survey and plat made by J. G. Carroll, R. L. S., dated August, 1947. Tract No. 2. Beginning at a . stone in the Averette line on the Southeast side of an unpaved county road, and about 100 feet therefrom; thence along the George Carlson line, N. 48° 40’ W., 1095 feet to the corner of Lucy Fowler’s land in the said Carlson line: thence with Fowler’s line N. 89° E., • 1065 feet to R. A. Aver ette’s line (formerly Upchurch land); thence along said Aver ette’s line S. 3° 45’ W„ 930 feet to a stake; thence N. 39° 25’ W., beginning, containing 10.8 acres, according to the plat referred to in the first tract. Save and except one acre previously sold by Hardy to James and Laura Hinton. The above deed of trust conveys 292 feet to a stone, the point of an undivided one-sixth interest in and to the above described lands, and this sale is held to offer for sale, a one-sixth undivided inter est, in the above described tracts of land.
