Tuesday, December 2, 1S75 Tha Dally Tsr HI7 3 C 3 From the wires of United Press International SAN FRANCISCO Patricia Hearst's attorneys said Monday they may not enter any defense for her in her trial on armed robbery charges if the government does not present a "credible" case. Albert Johnson, an attorney for the 21-year-old newspaper heiress, said the no defense possibility was contained in a memorandum he sent Monday to the U.S. District Court clerk's office. His statement came a day after he said he would not present an insanity defense for Miss Hearst. But he left open the possibility of a brainwash defense. Miss Hearst was kidnaped Feb. 4, 1974, by the Symbionese Liberation Army and later joined the terrorist band. After her capture last Sept. 18, she said she was brainwashed during her 19 months as a fugitive. Her trial starts Jan. 26. Johnson's memorandum came in response to a demand by the prosecution that Miss Hearst's attorneys disclose by Monday whether they will use any kind of defense of diminished mental capacity, including brainwashing. Stevens confirmation may be delayed WASHINGTON Assistant Senate Democratic leader Robert C. Byrd expressed doubts Monday that Supreme Court nominee John Paul Stevens can be confirmed this year before Congress adjourns. However, Byrd said Stevens' chances of being confirmed before then "would be improved" if the Senate stays in session a week beyond its targeted Dec. 12 adjournment date. Sullivan's tape was heard after Hoover's secretary of 50 years, Helen W. Gandy, said she followed Hoover's orders and destroyed his personal correspondence after he died May 2, 1972.
