That it is hereby made the duty of I he Board' of Aldermen of the towu of Plymouth, N. C , to order and provide for an election to be held at the Court House in Ply mouth on the Cth day of May, 1UU3, under the atne rules, laws and reg ulations as elections in said town are held as to the hours of voting and the registration of voters and the of ficers to preside over and control said election us is provided by the charter of said town, first making publication thereof thirty days "in a newspaper in &aid town, or if none, at live public places in the said dis trict, and shall provide ballots with out device for all voters in said ter ritory on which shall be written or printed the words "For School," and the words "Against School," and if a majority of the qualified voirrs in said territory all of whom living in said territory and other wise qiraliiied under the constitution of this'State shall be entitled to vote at sai(j election, thai! vote for schools, thed-it shall be the duty of the said Board of Aldermen as soon as prac ticable, and annually thereafter, to levy a special tax for the support of the graded schools hereinafter pro vided for on all the property real and personal within said limits and all the persons, linns and corpora tions and all the solvent credits of such persons roiidihg therein. Said tax shall not exceed fifty cents on the one hundred dollars valuation of such property and one dollar and Jifty ceiits on the poll, and the said tax shall be due and payable when and in like manner as all other taxes are due and payable in this State and the tax lut in the hands of the Sher iff of the county shall be and consti tute a lien on all propeity within said limits uud ho shall have the same rigliU and powers in collect ing taxes of the State uud county, provided that if the oflicers of the said election shall ascertain that a majority of said qualified voters have voted "for kchools" and shall enter the same on the books or records of same such entry shall be prima facie evidence that a majority of Said vo ters did so vote ah'4, shall a'iilhorlfce the said levy, provided further,'. ,tJiat if a majority of said voters shall not so vote and it snail be so declared by the said ollicers of the t-aid elec tion, the said Board of Aldermen shall on a written petition of oue fifih of the qualified voters within the said limits call another election at such time as may be designated in said petition, not later than the lirst day of J une, J;.04, which shall be under the same regulations as herein prescribed for the election aoove provided for, and if at Un said last named election a majoiit) of the qualified voters shall yote for schools the said levy before provided for shall be niado as herein provided J for the said lirst mentioned levy. Sec. o. That it shall be the duty cf the herili of the County of ash mgton to ascertain as soon as the books of taxes are in his hands the exact mileage of any and all railroads lying within the said limits and to notify the agents of such roirids 'there otaud the 'valuation thereof for the purposes of the levy provided by this act' shall be as prescribed by the Corporation Conimissioii'of the State in their general valuation of the railroads of this State. Sec. -t. That the Sheriff shall inv over to the Treasurer of the town of Plymouth all moneys collected un der said act who shall keep a separate book and account of same uud shall pay the same out for the purposes of the said schools on the order of the Chairman of Board of Trustees who shall be appointed by the Hoard, and the said Treasurer shall enter into bond hifore receiving the said moiioy and at the end of each term shall render a full report to said Board. That the Chairman of MiidJ Board shall preside at the meeting of the Board ami shall have a casting vote in case of a tie. The said Board shall elect a principal for said schools and as many teachers as shall bo necessary and fix tiie salaries of the same, and tiie principal of the white school shall be required to examine also the condition of the colored school from tune to time and report the same to the Board and make such recommendations as he may think needful, ile shall be require d to report on the condition of his said school to the Board of Trustees a copy of which shall be annually certified to the B mrd of Education of the State as the Board may deem just and necessary. Any teacher or principal may for ineliieieney of ser vice be removed by the Board. The said Board shall be a body corporate under the name of The Board of Trustees of Plymouth C raded Schoo1, and entitled to sue and be sued in law or in equity and shall by the consent of the Board of Aldermen of the town of Plymouth and by assign ment from them succeed to any and all rights in law or equity that said Board of Aldermen may possess for the purpose of obtaining and having possession of any building for the purpose of said school and any action that may be commenced bv them for this purpose shall be brought in any county in the first judicial dis trict of this State as the said Board may elect and shall stand for trial on the docket of said Court at the re turn term of the summons piovided the same has been served thirty days before the call of said case for trial and shall take precedence of all civil causes at said term. The said Board of Trustees shall consist of seven, who shall bo in favor of Public Ed ucation to be elected by the said Board of Aldermen on 1st Monday in June, 1003, two for G years, two for 4 years and three for 1 year. They shalbbo called together by the Chairman as often as the necessities of the said schools shall demand and shall serve without compensation.
