A company alleged to have damaged
two buildings during construction
of the Holdcn Beach Bridge is claiming
any damage was the result of the
age and condition of the buildings.
A suit filed Nov. 21 by J.W. and
Idllian Robinson of Supply claimed
that vibrations from pile driving during
construction of the bridge in 1985
caused extensive damage to their
home. They are seeking $42,240 in
damages and $200,000 in punitive
damages.
Their home is located on the west
side of N.C. 130 adjacent to the bridge
structure.
Another suit filed in November by
James Robert and Princess Pearl
Robinson claims their oyster shucking
house was destroyed by the vibrations
from the pile driving.
They are seeking $45,890 in
damages and $200,000 in punitive
damages.
Their property is located on the
east side of N.C. 130 adjacent to the
bridge structure.
In responses filed Nov. 25 and Dec.
4 respectively in Brunswick County
Superior Court, l.ee Construction
Company of Charlotte denies any
negligence in either case.

A full-scale drill Is held every five
years by the state to prepare
emergency management arid law officials
should a real disaster occur at
CP&L's Brunswick nuclear plant.
Officials from seven North
Carolina counties and one South
Carolina County were involved in the
Other drills are held at one year intervals,

Brunswick and New Hanover counties.
Cecil Logan, county emergency
management coordinator, said

Dismissals
Further, the answers alleged that
if the defendant were in any way
negligent that "plaintiffs were guilty
of contributory' negligence in that if
they saw damage occurring to their
property they were under a duty to
protect such property and failed to do
so."
The company lias requested the
cases be dismissed; otherwise it
seeks jury trials.
The answers also contend that
plaintiffs' property "was in poor condition
that was unknown to the defendant
at the lime it was doing this
work, and due to the age and poor
condition of the property it might
have suffered some minor and slight
damage during the period work was
being done in the vicinity."
"If there was any damage it was
mainly due to the age of the building
and was easily correctable. In any
event, any damage done was not due
to any negligence or wrongdoing of
this defendant," according to the
answers.
Also, the responses claim the construction
firm "relied on the
knowledge, expertise and protection
of the N.C. Department of Transportation
in doing the work it was told to
do." and that it "performed its work
in the normal, customary and proper
manner and liad no knowledge or
forewarning that any damage might
result."

federal evaluators told liitn it was
one of the most successful drills ever
and that their agency was pleased
with the performance of all participants.
"We liad about seven objectives,
and we met them all with success,"
said Logan.
Those objectives include alert
mobilization of the emergency
response staff, coordination of the
emergency broadcasting system and
the message log system, with an emphasis
on a uniform numbering
system to track response actions.
"If a real emergency situation ever
did happen," said Logan,
"Brunswick County can handle the
situation."

CP&L Spokesperson Elizabeth
Beam said Brunswick and New
Hanover counties played the largest
part in the exercise, since they would
be the closest in case of real disaster.
An informal evaluation given by
FEMA Thursday called it a very successful
exercise, she said.
The drill included officials from the
Nuclear Regulatory Agency and the
N.C. Division of Emergency Manage
mem as well as otlictals from the
eight participating counties.
Participants took samples of
vegetation, water, milk and fish to
determine if they had radiation contamination.
and simulated the steps
taken toward evacuation during the
drill.
