Part 930, Subpart H. The appeal anses from an objection by the State of North Carolina (State) to the appellant's consistency certifica tion that his proposal to construct a bulkhead and fill wetlands and waters of Boiling Springs l^ike in Hmnswick County, North Carolina, for which a U.S. Army Corps of lin ginccrs* (Corps) permit must be obtained, is consistent with the State's coastal zone man agement program. The State's objection precludes the Corps from issuing a permit for the activity unless the Secretary finds that the activity is either "consistent with the objectives" of the CZMA (Ground I) or "necessary in the interest of na tional security" (Ground II) Section 3(J7 (c) (3) (A). Mr. Fuller has appealed on the basis of Ground I. To make ihc determination that the pro posed activity is "consistent with the objec tives" of the CZMA, the Secretary must find thai: (1) the proposed activity furthers one or more of the national objectives or purposes contained in ? 302 or ? 303 of the C/MA , (2) the adverse effects of the proposed activity do not outweigh its contribution to the national interest, (3) the proposed activity will not vio late the Clean Air Act or the Federal Water Pollution Control Act, and (4) no reasonable alternative is available that would pennit the activity to be conducted in a manner consis tent with State's coastal management pro gram.
