Page 2A—MIRROR-HERALX)—ThiiTsday, November 17, 1977 Grover To Deal With KM (Begins On Page lA) "1 believe the substantial com pletion date was (X:t. 7, 40 days after the contract completion date,” Flaher said. "Following the contract document conditions, I recommend that Harris pay the $4,000 liquidation damages." The contract calls for $100 per day past the completion deadline. Mayor McCarter pointed out that the system Is still not completed and suggested the council wait until the project Is "100 percent complete before making a decision on the damages.” Harris suggested the damages be set at the amount of additional engineering costs to the town rather than the $4,S00. He said he has already lost money on the project due to the delays In getting the materials needed to finish the job. "I also have lost moiey (m this job because the original specifications I bid on had no mention of house services Included,” Harris said. “But I have had to Include work on house service connections.” Fisher said the work order change elevates the original con tract price of $S4,3M.S8 to $86,091.98. To date the town has paid $28,730.86 on the contract, leaving a balance of $6,861.13. OxincU approved the work order change, but declined to decide the matter of liquidation damages to be accessed from the contractor. Council member Martha Byers made a motion that the board wait until the project Is completed, then call a special meeting, “If necessary, to settle this question of damages.” — In other matters, the board heard Fishers’ suggestions to begin working on a feasible sewer rate schedule for customers.
