C., FEB. 25— (UP)—The room is red-draped, carpeted in heavy plush, and the five chairs are black and high and soft where North Carolina’s Old Men sit and balance the scales of justice. Of course they have heard of President Roosevelt’s plan to re tire justices of the United States Supreme Court at the age of 70 and also, to increase the number of justices. Under a constitutional amend ment the State Supreme Court is to be increased from five to seven members. But there is nothing a bout retiring the state justices at the age of 70. Whatever the five members who now occupy the big room in the Supreme Court Building here think about the president’s proposed plan and that of the state in increas ing the justices they are keeping quiet. 0 Apart because of jurisdiction, the United States Supreme Court and the North Carolina Supreme Court, however, have one thing in common under the new proposals —that of an increase in member ship. Fact is that the State Supreme Court will be increased. But there is doubt about whether Congress Will agree with the president. For years the State Supreme Court has carried on its work with out bringing words down upon its head from the people. There has been talk that some of the justices were getting pretty old, but no one doubted their in tegrity. Their word, as far as the people of the state are concerned, has been satisfactory. a North Carolina justices are all on the shady side of 50, but only one is really old. “Only in years am I old,” says Justice Heriot Clarkson, 74. “In spirit I’m a young man.” He is a baldish little man who likes to stop you on the street and talk. He never forgets a face or a name. He was born in Charlotte, a Democrat he says, and served in the 1899 General Assembly known as the “white supremacy legisla ture. Cameron Morrison as Gov ernor appointed him to the bench in 1923. He ran for the office three years later, was elected for eight years and re-elected for a similar term in 1934. ^ So as the eyes of the country turn toward Washington and the President’s proposal, North Caro linians speculate who will fill the two additional places on the State Supreme Court Bench. To the fore has come the name of A. A. F. Seawell, the state’s 73-year-old attorney general. Many believe Gov. Hoey will appoint Seawell, move Hubert Olive of Lex ington, Hoey campaign manager, into the attorney generalship. Another mentioned for the bench is J. Wallace Winborne of Marion, chairman of the State Democratic Committee. Too, some think Spe cial Judge G. V. Cowper of Kinston will be appointed from the east, while the west mentions Judge Fe lix Alley of Waynesville along with Winborne.
