Joe got nicked.” M’MULLAN RULES ON VOTE RIGHTS RALEIGH, April 26. — ta>> — At torney General Harry McMullan held in a digest of opinions releas ed today that a police officer does not have the right to arrest and hold without bond a North Caro lina citizen on a justice of the peace warrant from another state. Only in cases of a capital felony does a police officer have the right to hold a person without privilege of bond, McMullan said in giving opinions on a variety of questions relating to state statutes. In ether opinions, he held that: Under our law a prosecuting wit ness has no right to appeal in a criminal action before a justice of the peace in which the defendant is acquitted. However, in case the prosecution if found to be frivo lous and the prosecuting witness was assessed with the costs, he may appeal to the Superior court on the question of payment of the costs. It is a violation of our criminal laws for any person to sell or give away cigarettes, or tobacco which may be used as a substitute for cigarettes, to any minor under the age of 17 years, or to aid and abet in such sale. It also is un lawful to assist a minor in obtain ing cigarettes. A person convicted of a misde meanor is not thereby deprived of the right to vote or run for office in North Caroling, as our constitu tion provides for such forfeiture on ly in case the offense involved is one which may be punished by confinement in the State Prison. • The question of residence of an elector is one to be determined by in xegisixax axiu juugca ux cxctuun of the precinct! and depends upon their determination of the inten tions of the elector in respect to relinquishing or retaining his place Df residence in the precinct.
