If when the problem is only theoretical, as it is now, there are such divided opinions, we can see that the risks of national dis unity and world wide confusion would be very great indeed if un happily the office of President be came vacant again. Mr. Truman’s proposal may not be the best pos sible one. But there can be no doubt that he had to make a def inite proposal, and that the Presi dent and Congress owe it to the country to settle the succession promptly—that is, before Mr. Tru man goes abroad. This means either that Congress should legislate, or, if Congress does not, that the President should appoint as Secretary of State a man recognized as having the qualifications for President. Either of these ways of settling the prob lem would be a satisfactory stop gap. A final and permanent settle ment need not be made in a hurry. As soon as Mr. Truman’s succes sor is designated clearly, Congress and the country can take the time to deliberate carefully on the per manent remedy for this curious defect in our constitutional system. * * * The immediate risk could be covered by Mr. Truman’s proposal. For while it is highly debatable whether the Speaker of the House should be the normal successor, it just happens to be the fact that Mr. Rayburn is an experienced and widely trusted public servant. The objection to making the Speaker the normal successor is that this is inconsistent with the principle - _ , I of the separation of powers, and that it could easily cause confusion if the party control changed at the mid - term elections and a new Speaker belonging to the opposi tion party became the heir appar ent. But these objections would not matter if Mr. Truman’s proposal were adopted now as a stopgap measure. The risk could also be covered by his appointing a new Secretary of State, especially if this were done with the understanding that the Congress would legislate as soon as the problem of the succes sion can be explored and debated. * * • The permanent problem, it seems to me, may be defined as follows: When the President dies or is incapacitated, the Vice-Presi dent succeeds him. Then there is a new President. But there is no Vice-President. Therefore, the so lution of the problem will be found in deciding how to choose a new Vice-President. Mr. Truman argues for the prin ciple that no man should become President who has not been passed upon by the people of the country. That is, obviously, the sound prin ciple, and the way to apply it un equivocally would be to provide for the election of a Vice-President as soon as possible after the office of Vice-President has become vacant. There is no particular reason why this could not be done in six weeks, and in .he interval the Secretary of State could stand by to be, in case of emergency. Acting Presi dent until the election of the new Vice-President. There is some rea son to think, though the language is obscure, that something like this may have been the original intent of the authors of the Constitution. * * » In any event, we must bear in mind that nothing is so essential to orderly government as an undis puted and universally accepted line of succession to the highest office in the land. -V AERIALISTS INJURED CLIFTON, N. J., June 25.—UP)— Three women aerialists were in jured in a 35-foot fall here Satur day night when a trapeze cable snapped at the beginning of their act in the Clyde Beatty circus. This total represented 38.5 per cent of the $1,940,000,000 collected by all 48 states from all their ma jor excise taxes during the year. It was a 7.5 per cent increase over 1943 collections and 44.7 per cent over 1940. California collected the greatest amount, $140,000,000, Michigan took in $95,800,000; Illinois $90, 000,000; Ohio, $67,100,000; Wasn ington, $59,700,000. California's sales tax receipts, however, rose by only .9 per cent over the pre ceding year because of a cut in the tax rate in July, 1943, from 3 to 2 1-2 per cent. Illinois collections were slightly above the all-stars average of 7.5 per cent. The Illinois inciease was 8.1 per cent while Michigan’s 6.6 per cent was below the all-states average. Indiana reported the greatest percentage increase, 17.9 per cent others included North Dakota, 15.8 per cent; Washington, 14.3 per cent; Oklahoma, 13.8 per cent; Colorado, 13.3 per cent; Wyoming, 12.5 per cent; Iowa, 12.4 per cent, and Louisiana, 12 per cent. UNC GRADUATES HEAR ATTORNEY CHAPEL HILL, June 25.—(JP)— Graduates of the University of North Carolina, numbering 365, were told today that they must muster courage and faith to pre serve the peace for generations to come. Delivering the University’s sesquicentennial commencement address, Kemp D. Battle, Rocky Mount attorney and UNC alumnus, declared, “the plan of Dumbarton Oaks, implemented at San Fran cisco, glows with promise, but it is, after all, the first step in a long and tedious process. We must accept it and through the years strive to perfect it. Around that goal cluster the brightest hopes of mankind.” Chancellor Robert B. House pre sided at the Kenan Stadium ex ercises and John D. Waldroup. of Hayesville, class president, re sponded to Battle. Governor R. Moses, of Knox ville, Tenn., former pioneer of | education in this state. _IT_ WAR LOAN PASSES 20 BILLION MARK WASHINGTON, June 25 — (TP) — The “Mighty Seventh” War Loan drive rolled past the 20-billion dollar mark today. Treasury Secretary Morgenthau said “it would appear that we are going to set a new high in total sales for the seven war loans to date.” The record is $21,261,000,000 in the Sixth War Loan last winter. “More importantly,” Morgen tnau said, “sales to individuals now have broken the all-time rec ord in that category. Individual sales are $6,959,000,000. The indi vidual record was $6,351,000,000 in the Fifth War Loan a year ago.” The secretary said, however, in a statement that higher goals had been set for individual participa tion in this drive than ever before and there is ‘‘still much work re maining to be done by volunteers hroughout the country.’* The individual quota Is $7,000, 000,000 in this drive which end3 Saturday with the accounting per od running on through July 7.
