WOMAN IS GIVEN
LONG SENTENCE
Maude Nelson Enter* Pie* of Mur
der In Second Degree
Maude Nelson, 21 charged with the
murder of Mrs. .Martha McClure, 35
near Andrews last April 2, Thursday
was sentenced to serve from 15 to
20 years in State's Prison, Raleigh,
after defense attorneys had entered
a plea of guilty of murder in the
second degree.
After the State and defense had
rested. Judge H. Hoyle Sink, presid
ing ove'r Cherokee county Superior
Court here, suggested that a plea of
second degree murder be entered, al
though the evidence, he said, was
ample to sustain first degree murder.
The court stated that it would not
let a fir?t degree verdict stand, ow- ,
| inp: to the low mentality of the de
' fendant.

tion. the defense attorneys entered !
the plea.
Trial of the case began at 8 o'clock I
Thursday morning. August 1 1th and
more than two hours we're spent in j
selecting a jury from a special venire ;
of 40 men. A statement, signed by ?
Mrs. McClure on her death bed, was
presented in evidence. It was to the
effect that on April 2 Maude Nel
son asked her to go to the home of
her aunt. Mrs. Theo Gibby, to see Mrs.
Gibby's sick baby.
On the way, she said, the Nelson
heard that she objected to her asso
woman told Mrs. McClure she had
ciating with her daughter. Mrs. Mc
Clure, in her statement, said she told
her that she did not say this, where
upon the Nelson woman accused her
of lying and stabbed her in the left
breast with a knife.
Physicians testified that as a re
sult of the wound, pneumonia de
veloped, from which she died April
17.
-Maude Nelson testified that Mr?.
McClure attacked her fifrst with a
rock.
