The Chei NOTICE OF SALE OF ASSETS OF THE Merchants & Manufacturers Bank ANDREWS, NORTH CAROLINA In accordance with the provisions of the Consolidated Statute^ of North Carolina, Article 3, Paragraph 218 (c), subsection 7, and an Order of Hon. Wilson War lick. Judge Presiding and Holding the Courts of the Twentieth Judicial District, entered December 3. 1935. after due notice to all creditors and depositors, the undersigned will, BEGINNING AT 10:00 A. M. EASTERN STANDARD TIME, ON MONDAY. THE 27TH DAY OF JANUARY, 1936. AT THE PUBLIC LIBRARY IN THE TOWN OF ANDREWS. CHEROKEE COUNTY. NORTH CAROLINA, and continuing from day to day, beginning at the .same hour each day until j said sale is completed, offer for sale, item bv item, in croups, and as a I whole, to the highest bidder for cash, or claims at their equity value of both, the real estate, notes, judgments, furniture and fixtures, and anv other property of the MERHAYRS AM) MANUFACTURERS BANK, hereinafter described. The undersigned does not warrant title to the properties described below, and will sell said properties without recourse, subject to any and all equities and defenses which may be plead against the same: and including all, offsets which, it is understood, embraces the right and duty of the Commissioner of Banks and ' or his agents to withhold any and all dividends on debtors claims to reduce loss or losses sustained on their respective evidences of indebtedness, stock assessments and or interest on either. All assets subject to prior sale. The undersigned reserves the right to offer various- items of assets for sale, item by item, in groups, and as a whole. The right is also reserved to reject or accept any or all bids made at the sale. Any and all sales made pursuant to this advertisement are subject to confirmation of the Superior Court of Cherokee Countv, N. C. TERMS OF SALE: CASH UPON CONFIRMATION. The highest bidders I excluding claim holders using only their equities in their claims) will be required to deposit 10 per cent of the amount of their bids at the time of sale as a guarantee of performance, and bidding on no part of .-aid properties shall be deemed closed until such bidders shall have complied with this requirement. Owners of claims against the Merchants & Manufacturers Bank may use 15 per cent of the face amount of their claim as if it were cash in bidding on any of the assets offered for sale. (Concrete example: A claimant who had $ 100.00 in the bank when it closed could use $15.00 of this as cash in bidding on assets.) Accrued interest to January 1, 1936, on notes and judgments is shown herein, but interest on principal balances from said date to date of sale Will be added to total due.
