The opening waa steady, but at a de cline of I to points, owing to disap pointing English - cables, report of a v lighter English pot demand and the ap prehensions over March notice. March old 20 point under May on the call and at this difference there waa heavy buying of March against aalea of May and July ;by pot people, and bunking Interests, who saw a small profit In tht operation above carrying charge or who '. were undoing prevou straddle. This tended to support the March option while depressing the later months, and the difference gradually narrowed to about It point with the whole list wording lower In the meantime, until March sold at 0.08, or even with tho low level of February 4th and May at D.2S. which was I point below the previous low record. When court convened thla afternoon at 3 o'clock, counsel for the defense challenged Juror Charlie Shope on the ground that he waa of kin to the deceased Charlie Powers. The defense Introduced affidavits re citing as fact that Juror Shopes great grandfather was a brother of the great great grandmother of the de ceased Charley Powers. After lengthy argument by toth sides, Judge Cook ordered a mistrial. The court Instructed the clerk to make an entry on the minutes to the effect that, "it appearing to the court that Juror Charles Shope was relat ed to the deceased, Charlie Powers, In the nint degree, it Is therefore or dered that a mistrial be had." The court Instructed that entry be made to the effect that Juror Shope was not aware of his relation to the deceased,' and that the defense was not aware of this fact when the Jury was accepted. The question of ball for Francis Sumner will be argued to-morrow probably. Judge Cook, when this question was touched, gave no intima tion that he would allow ball. When Sumner was called to trial the State agreed to prosecute only for murder In the second degree. Since a mistrial is had, Judge Cook announced that the case now reverts to the Indictment, and that Sumner is simply held for murder. Sumner shot and killed Powers at Ardea, in December. The case has attracted great interest, and during the progress of the trial thj court room has been crowded with friends and relatives of the man on trial and of deceased, the costs In the case will already amount to $1,000.
